No. 110/2001 Discharged Servicemen's Preference Act 1943 Discharged Servicemen's Preference Regulations 2001 The Governor in Council makes the following Regulations: Dated: 23 October 2001 Responsible Minister: MARSHA THOMSON Minister for Consumer Affairs HELEN DOYE Clerk of the Executive Council 1. Objective The objective of these Regulations is to— (a) prescribe theatres of war for the purposes of the Act; and (b) prescribe the manner in which evidence of service may be provided. 2. Commencement These Regulations come into operation on 1 November 2001. 3. Authorising provision These Regulations are made under section 18 of the Discharged Servicemen's Preference Act 1943. -- 2 of 5 -- S.R. No. 110/2001 Discharged Servicemen's Preference Regulations 2001 2 4. Definition In these Regulations "the Act" means the Discharged Servicemen's Preference Act 1943. 5. Revocation The Discharged Servicemen's Preference Regulations 1992 1 and the Discharged Servicemen's Preference (Amendment) Regulations 1999 2 are revoked. 6. Theatres of war For the purposes of the definition of "discharged serviceman" in section 2(1) of the Act the prescribed theatres of war are those referred to in the Schedule. 7. Evidence of service For the purposes of the definition of "discharged serviceman" in section 2(1) of the Act the prescribed manner of providing evidence is— (a) the provision of a certificate of discharge; or (b) the provision of a statement of service; or (c) the provision of any other document— issued by the appropriate authority on completion of the person's war service in any of the forces, services or bodies referred to in the said definition. __________________ r. 4 -- 3 of 5 -- S.R. No. 110/2001 Discharged Servicemen's Preference Regulations 2001 3 SCHEDULE PRESCRIBED THEATRES OF WAR 1. The United Nations operations in Korea The area of Korea, including the waters for a distance of 100 nautical miles seaward from the coast of Korea between 6 June 1950 and 20 April 1956 (both days inclusive). 2. The operations in Malaya (including Singapore) (a) the area of Malaya and Singapore, including the waters for a distance of 10 nautical miles seaward from the coast of Malaya, between 29 June 1950 and 30 September 1967 (both days inclusive) provided that the person was attached to a body, unit or detachment of the forces which were based on the Malayan Peninsula or in Singapore; or (b) the area of Malaya north of parallel 4 degrees north after 30 September 1967 provided that the person was attached to a body, unit or detachment of the forces which were based on the Malayan Peninsula. 3. The operations in Vietnam The area of Vietnam, including the waters for a distance of 100 nautical miles seaward from the coast of Vietnam, between 31 July 1962 and 29 April 1975 (both days inclusive). 4. The operations in Sabah, Sarawak and Brunei The area of Sabah, Sarawak and Brunei, including the waters for a distance of 50 nautical miles seaward from the coasts of Sabah, Sarawak and Brunei, from 8 December 1962 to 30 September 1967 (both days inclusive). ═══════════════ Sch. -- 4 of 5 -- S.R.
