No. 156/2001 Livestock Disease Control Act 1994 Livestock Disease Control (Further Amendment) Regulations 2001 The Governor in Council makes the following Regulations: Dated: 18 December 2001 Responsible Minister: KEITH HAMILTON Minister for Agriculture HELEN DOYE Clerk of the Executive Council 1. Objective The objective of these Regulations is to make— (a) consequential amendments to the Livestock Disease Control Regulations 1995 arising from the Livestock Disease Control (Amendment) Act 2001; (b) other minor amendments to those Regulations. 2. Authorising provision These Regulations are made under section 139 of the Livestock Disease Control Act 1994. 3. Commencement These Regulations come into operation on 1 January 2002. 4. Principal Regulations -- 2 of 7 -- S.R. No. 156/2001 Livestock Disease Control (Further Amendment) Regulations 2001 2 In these Regulations, the Livestock Disease Control Regulations 19951 are called the Principal Regulations. 5. Cattle and pigs to be identified In regulation 7 of the Principal Regulations— (a) in sub-regulation (1) omit "cattle and"; (b) in sub-regulation (3), paragraph (b) is revoked. 6. Ear and tail tags In regulation 8 of the Principal Regulations, sub- regulations (5) and (6) are revoked. 7. New regulation 11 inserted After regulation 10 of the Principal Regulations insert— "11. Prescribed circumstances For the purposes of section 9A(1)(b) of the Act the prescribed circumstances in which cattle must be tagged, marked, branded or identified are— (a) cattle born in Victoria prior to removal of the cattle from the property of birth; (b) cattle removed from their property of birth and moved to a property in Victoria, within 30 days after arriving at that property.". 8. Removal of tags (1) In regulation 12(2) and (3) of the Principal Regulations, omit "(except a tag referred to in regulation 7(3)(b))". (2) In regulation 12 of the Principal Regulations, for sub-regulation (4) substitute— r. 4 -- 3 of 7 -- S.R. No. 156/2001 Livestock Disease Control (Further Amendment) Regulations 2001 3 "(4) Sub-regulations (2) and (3) do not apply to an ear tag that contains a property identification number and an individual identification number for the cattle that has been issued by a manufacturer under a licence granted by Meat & Livestock Australia Limited (ABN 39 081 678 364).". 9. Carcase to remain identified In Regulation 15 of the Principal Regulations, after "identification tag or tattoo" insert "required by the Act or these Regulations". 10. New regulation 15A inserted After regulation 15 of the Principal Regulations insert— "15A. Applications for identification numbers For the purposes of section 9B(2)(a) of the Act, the prescribed manner of making an application is— (a) in writing in the form approved by the Secretary and sent by post or by fax to the Secretary; or (b) any other form of communication approved by the Secretary.". 11. Records of sale (1) For paragraph (b) of regulation 37A of the Principal Regulations substitute— "(b) the prescribed particulars about the livestock sold are— (i) the name and address of the seller; (ii) the date of the sale; (iii) the location of the sale; r. 9 -- 4 of 7 -- S.R. No. 156/2001 Livestock Disease Control (Further Amendment) Regulations 2001 4 (iv) a description of the livestock including species, age and sex; (v) the number of each of the prescribed species sold; (vi) the name and address of the purchaser; (vii) in the case of cattle remaining in Victoria after the sale, the property identification number for— (A) the property, not being a saleyard, where the cattle were last permanently held (being for a period longer than 7 days); (B) the property on which the cattle are to be kept.". (2) At the end of regulation 37A of the Principal Regulations insert— "(2) For the purposes of sub-regulation (1)— (a) the property identification number to be used is the property identification code allocated by the Secretary or, if the cattle have originated from another State or Territory, the property identification number or code applied in accordance with the laws of that State or Territory; (b) if a property identification number or code has not been allocated in respect of the cattle, the address of the property may be used instead of the property identification number or code.". 12. New Part 10 inserted r. 11 -- 5 of 7 -- S.R. No. 156/2001 Livestock Disease Control (Further Amendment) Regulations 2001 5 After regulation 43 of the Principal Regulations insert— 'PART 10—TRANSITIONAL 44. Transitional tag requirements Despite Part 3 and Parts A to E of Schedule 3, an ear tag or tail tag that includes a reference to "V" and a region of Victoria is deemed to comply with the requirements of section 9 of the Act until 1 January 2003.'. 13. Ear and tail tags and tattoo brands In Schedule 3 to the Principal Regulations— (a) for "V*" (wherever occurring) substitute "3". (b) after "Secretary" (wherever occurring) insert "under section 9B of the Act"; (c) Parts J and K are revoked. 14. Statute law revision In regulation 5 of the Principal Regulations, in the definition of "veterinary surgeon" for "Veterinary Surgeons Act 1958" substitute "Veterinary Practice Act 1997". ═══════════════ r. 12 -- 6 of 7 -- S.R.
