No. 57/2001 Road Safety Act 1986 Road Safety (General) (Traffic Infringements Amendment) Regulations 2001 The Governor in Council makes the following Regulations: Dated: 19 June 2001 Responsible Minister: PETER BATCHELOR Minister for Transport HELEN DOYE Clerk of the Executive Council 1. Objective The objective of these Regulations is to amend the Road Safety (General) Regulations 1999— (a) to increase certain infringement penalties for drivers of vehicles and riders of bicycles who disobey the Road Rules in respect of speed-limits and traffic lights; and (b) to update the traffic infringement descriptions for certain blood alcohol offences in consequence of the enactment of the Road Safety (Alcohol and Drugs Enforcement Measures) Act 2001; and (c) to create an infringement for probationary drivers who fail to display "P" plates; and (d) to assign new infringement Codes to certain infringements. -- 2 of 6 -- S.R. No. 57/2001 Road Safety (General) (Traffic Infringements Amendment) Regulations 2001 2 2. Authorising provision These Regulations are made under section 95 of the Road Safety Act 1986. 3. Commencement (1) These Regulations, except regulation 6, come into operation 1 July 2001. (2) Regulation 6 comes into operation on 28 June 2001. 4. Principal Regulations In these Regulations, the Road Safety (General) Regulations 1999 1 are called the Principal Regulations. 5. Increase in certain traffic infringement penalties In Schedule 4 to the Principal Regulations— (a) in the entry in respect of Code 1901, for "140" substitute "170"; (b) in the entry in respect of Code 1902, for "220" substitute "265"; (c) in the entries in respect of Codes 1903 and 1904, for "450" substitute "540"; (d) in the entries in respect of Codes 1905 and 1906, for "900" substitute "1080"; (e) in the entry in respect of Code 2001, for "165" substitute "200"; (f) in the entry in respect of Code 2002, for "105" substitute "125"; (g) in the entry in respect of Code 2003, for "220" substitute "265"; (h) in the entry in respect of Code 2004, for "165" substitute "200"; r. 2 -- 3 of 6 -- S.R. No. 57/2001 Road Safety (General) (Traffic Infringements Amendment) Regulations 2001 3 (i) in the entries in respect of Codes 2005 and 2006, for "300" substitute "360"; (j) in the entry in respect of Code 2007, for "360" substitute "430"; (k) in the entry in respect of Code 2008, for "165" substitute "200"; (l) in the entry in respect of Code 2222, for "165" substitute "200". 6. Substitution of traffic infringement descriptions for certain blood alcohol offences In Schedule 4 to the Principal Regulations, for the entries in respect of Codes 2093 and 2094 substitute— "2093 Drive or be in charge of motor vehicle with unlawful blood alcohol level of less than 0·05 g/100 ml RSA 49 240 2094 Drive or be in charge of motor vehicle with blood alcohol level of 0·05 or more but less than 0·10 g/100 ml RSA 49 300". 7. New traffic infringement for probationary drivers who fail to display "P" plates In Schedule 4 to the Principal Regulations, after the entry in respect of Code 2128 insert— "2129 Fail to display 'P' plates when required RS (D) R 217(1) 105". 8. Certain infringements assigned new infringement Codes In Schedule 4 to the Principal Regulations— (a) for the entry in respect of Code 2101 substitute— r. 6 -- 4 of 6 -- S.R. No. 57/2001 Road Safety (General) (Traffic Infringements Amendment) Regulations 2001 4 "2101 Fail to obey traffic lights RR 56(1), (2), 57(2), (3), 59(1), 60, 61(2), (5), 64, 65(2), 66(1), (4), 152(1), 281(a), (b), 282(a), (b), 284(a), (b), 286(2)(a), (b), (c), (3) 200 2149 Failure of driver of tram to obey T light RR 274(a), (b), 275(a), (b), 277(a), (b), 279(2)(a), (b), (c), (3) 200"; (b) for the entries in respect of Codes 2032 and 2033 substitute— "2032 Drive on wrong side of divided road RR 135(1) 165 2045 Drive in wrong direction on a one-way service road RR 136 165 2033 Drive on or over or to the right of double lines RR 132(2) 165 2046 Drive on or over painted island with double lines RR 138 165". ═══════════════ r. 8 -- 5 of 6 -- S.R.
