No. 83/2001 Road Safety Act 1986 Road Safety (Vehicles) (Domestic Partner Concessions) Regulations 2001 The Governor in Council makes the following Regulations: Dated: 21 August 2001 Responsible Minister: PETER BATCHELOR Minister for Transport HELEN DOYE Clerk of the Executive Council 1. Objective The objective of these Regulations is to amend the Road Safety (Vehicles) Regulations 1999 to recognise the legal rights of all domestic partners irrespective of the gender of each partner. 2. Authorising provision These Regulations are made under section 95 of the Road Safety Act 1986. 3. Commencement These Regulations come into operation on 23 August 2001. 4. Definitions (1) In regulation 105(1) of the Road Safety (Vehicles) Regulations 1999 1 — (a) after the definition of "dog trailer" insert— -- 2 of 4 -- S.R. No. 83/2001 Road Safety (Vehicles) (Domestic Partner Concessions) Regulations 2001 2 ' "domestic partner" of a person means a person to whom the person is not married but with whom the person is living as a couple on a genuine domestic basis (irrespective of gender);'; (b) for the definition of "spouse" substitute— ' "spouse" of a person means a person to whom the person is married;'. (2) In regulation 105 of the Road Safety (Vehicles) Regulations 1999, after sub-regulation (3) insert— '(4) For the purposes of the definition of "domestic partner" in sub-regulation (1), in determining whether persons are domestic partners of each other, all the circumstances of their relationship are to be taken into account, including any one or more of the matters referred to in section 275(2) of the Property Law Act 1958 as may be relevant in a particular case.'. 5. Recognising domestic partners In the Road Safety (Vehicles) Regulations 1999, in regulations 229(1)(c), 230(2)(c), 232(3), 237(2)(a) and item 11 in the table in Schedule 4, after "spouse" (wherever occurring) insert "or domestic partner". ═══════════════ r. 5 -- 3 of 4 -- S.R.
