Objective The objective of these Regulations is to prescribe procedures and fees for appeals to the Gas Appeals Board and particulars regarding the reporting of the exercise of powers of entry. 2. Authorising provisions These Regulations are made under section 118 of the Gas Safety Act 1997. 3. Definition In these Regulations "the Act" means the Gas Safety Act 1997. 4. Form of notice of appeal A notice of appeal under section 81 of the Act must be in the form of the Schedule. -- 2 of 5 -- S.R. No. 30/2000 Gas Safety (Gas Appeals Board) Regulations 2000 2 5. Time for commencing appeal An appeal, other than an appeal under section 81(3) of the Act, must be lodged with the Gas Appeals Board within 28 days after notice of the decision, refusal, prohibition or requirement which is the subject of the appeal is received by the appellant. 6. Fees (1) The prescribed fee for an appeal to the Gas Appeals Board in relation to a decision under section 65, a refusal under section 69, a refusal under section 73, or a condition on an acceptance under section 69 or 73 of the Act is $200. (2) The prescribed fee for any other appeal to the Gas Appeals Board under the Act is $1000. 7. Reporting of the exercise of powers of entry (1) A report to the Gas Appeals Board under section 93(1) of the Act must be made within 3 business days after the exercise of the power of entry under Division 2 of Part 5 of the Act. (2) The report must be in writing and contain the following particulars— (a) the full name of the inspector who exercised the power of entry; (b) the address of the land or premises entered by the inspector; (c) the time of entry; (d) the purpose of entry; (e) a description of all things done while on the land or premises; (f) the time of departure. r. 5 -- 3 of 5 -- S.R.
