No. 148/1999 Conservation, Forests and Lands Act 1987 Conservation, Forests and Lands (Infringement Notice) (Amendment) Regulations 1999 The Governor in Council makes the following Regulations: Dated: 21 December 1999 Responsible Minister: SHERRYL GARBUTT Minister for Environment and Conservation HELEN DOYE Clerk of the Executive Council 1. Objective The objective of these Regulations is to amend the Schedule to the Conservation, Forests and Lands (Infringement Notice) Regulations 1992— (a) to prescribe further offences against a relevant law for which an infringement notice may be served; and (b) to prescribe the penalties for those prescribed offences. 2. Authorising provisions These Regulations are made under sections 91 and 99 of the Conservation, Forests and Lands Act 1987. -- 2 of 7 -- S.R. Principal Regulations In these Regulations, the Conservation, Forests and Lands (Infringement Notice) Regulations 19921 are called the Principal Regulations. 4. Amendment to Schedule of Offences In items 4283 to 4288 of the Schedule to the Principal Regulations, for "Park (Catchment Protection) Regulations 1997" (wherever occurring) substitute "Parks Regulations 1992". 5. Addition to Schedule of Offences After item 4289 in the Schedule to the Principal Regulations insert— "4290 An offence under regulation 5(5) of the Forests (Murrindindi Scenic Reserve) Regulations 1999 $100 camp in the reserve without having paid the relevant fee specified in regulation 5(3) where entry to the reserve has been by vehicle 4291 An offence under regulation 6(6) of the Forests (Murrindindi Scenic Reserve) Regulations 1999 $100 enter or use an area within the reserve that has been set aside under regulation 6(1) or enter a reserve or an area within the reserve to which access has been prohibited or restricted under regulation 6(2), in contravention of a determination displayed under regulation 6(5) 4292 An offence under $100 light, kindle or r. 3 -- 3 of 7 -- S.R. No. 148/1999 Conservation, Forests and Lands (Infringement Notice) (Amendment) Regulations 1999 3 regulation 8(1) of the Forests (Murrindindi Scenic Reserve) Regulations 1999 maintain a fire within 50 metres of a fixed fireplace 4293 An offence under regulation 17(1) of the Forests (Murrindindi Scenic Reserve) Regulations 1999 $100 bring a dog into or allow a dog to enter or remain in the reserve except in accordance with the regulations 4294 An offence under regulation 18(1) of the Forests (Murrindindi Scenic Reserve) Regulations 1999 $100 ride, drive, lead or bathe a horse in the reserve in an area not set aside for those purposes by the Committee 4295 An offence under regulation 19(1) of the Forests (Murrindindi Scenic Reserve) Regulations 1999 $100 bring an animal into the reserve, other than a dog or horse brought into the reserve in accordance with regulations 17(2) or 18(2) 4296 An offence under regulation 5(1) of the Forests (Steavenson Falls Scenic Reserve) Regulations 1999 $100 erect a tent or awning or use a caravan or other mobile structure for camping in the reserve without written authorisation of the Committee 4297 An offence under regulation 6(1) of the Forests (Steavenson Falls Scenic Reserve) Regulations 1999 $100 park a motor vehicle in the reserve in an area which has not been set aside for parking by the Committee 4298 An offence under regulation 6(5) of the Forests $100 park in the reserve without having paid the relevant vehicle r. 5 -- 4 of 7 -- S.R. No. 148/1999 Conservation, Forests and Lands (Infringement Notice) (Amendment) Regulations 1999 4 (Steavenson Falls Scenic Reserve) Regulations 1999 parking charge under regulation 6(3) 4299 An offence under regulation 7(6) of the Forests (Steavenson Falls Scenic Reserve) Regulations 1999 $100 enter or use an area within the reserve that has been set aside under regulation 7(1) or enter a reserve or an area within the reserve to which access has been prohibited or restricted under regulation 7(2), in contravention of a determination displayed under regulation 7(5) 4300 An offence under regulation 9(1) of the Forests (Steavenson Falls Scenic Reserve) Regulations 1999 $100 light or maintain a fire within the reserve other than in a fixed fireplace or in an area set aside by a determination of the Committee for lighting and maintaining fires 4301 An offence under regulation 18(1) of the Forests (Steavenson Falls Scenic Reserve) Regulations 1999 $100 bring a dog into or allow a dog to enter or remain in the reserve except in accordance with the regulations 4302 An offence under regulation 19 of the Forests (Steavenson Falls Scenic Reserve) $100 bring an animal into the reserve, other than a dog brought into the reserve in accordance with r. 5 -- 5 of 7 -- S.R.
