Objectives The objectives of these Regulations are to prescribe— (a) the particulars to be contained in a voters' roll; and (b) the form for a request for a poll; and (c) the fee to accompany a request for a poll; and (d) the form of the ballot-paper to be used in a poll. 2. Authorising provision These Regulations are made under section 56(1A) of the Docklands Authority Act 1991. 3. Commencement -- 2 of 6 -- S.R. No. 73/1999 Docklands Authority (Poll) Regulations 1999 2 These Regulations come into operation on 1 July 1999. 4. Definitions In these Regulations— "Act" means the Docklands Authority Act 1991; "silent voter" means an elector who has made a successful application to an electoral registrar under section 104 of the Electoral Act 1918 of the Commonwealth or section 66 of The Constitution Act Amendment Act 1958. 5. Voters' roll A voters' roll under section 35O(1) of the Act must include the following information— (a) a reference to the docklands area; (b) the year of the voters' roll; (c) the number of each voter on the roll; (d) the surname and other name or names of each voter; (e) except in the case of a silent voter— (i) the address in respect of which a voter is entitled to be enrolled on the voters' roll; and (ii) if a voter has a different postal address, that postal address. 6. Request for a poll A request for a poll of voters under section 35P(3) of the Act must— (a) be made in accordance with Form 1 of the Schedule; and r. 4 -- 3 of 6 -- S.R. No. 73/1999 Docklands Authority (Poll) Regulations 1999 3 (b) be accompanied by a fee of $10. 7. Ballot-paper for poll The ballot-paper to be used in a poll under section 35R(b) of the Act must be in accordance with Form 2 of the Schedule. __________________ r. 7 -- 4 of 6 -- S.R. No. 73/1999 Docklands Authority (Poll) Regulations 1999 4 SCHEDULE FORM 1 Regulation 6(a) Section 35P(3) Docklands Authority Act 1991 REQUEST FOR A POLL OF VOTERS I, one of the undersigned, being a person enrolled on the voters' roll for the docklands area, request the Docklands Authority to conduct a poll of voters to determine the voters' preference in relation to— [insert details of proposal] being a proposition relating to the Docklands Authority's municipal functions or to the future municipal management of the docklands area. To be a valid request for a voters' poll under section 35P(3), this Form must— • state the proposition (which must relate to the Dockland Authority's municipal functions or the future municipal management of the docklands area) to be put to the poll • be signed by not less than one-tenth of the voters on the voters' roll • be accompanied by the prescribed fee _______________ Sch. -- 5 of 6 -- S.R.
