No. 83/1999 Fundraising Appeals Act 1998 Fundraising Appeals Regulations 1999 The Governor in Council makes the following Regulations: Dated: 29 June 1999 Responsible Minister: JAN WADE Minister for Fair Trading STACEY ROBERTSON Acting Clerk of the Executive Council 1. Objectives The objectives of these Regulations are— (a) to prescribe certain activities as not being a fundraising appeal; (b) to specify requirements for collectors' identifying badges; (c) to exempt the Anti-Cancer Council of Victoria from the requirements of Part 3 of the Fundraising Appeals Act 1998; (d) to prescribe additional labelling requirements for clothing bins; (e) to prescribe the fee for inspecting records. 2. Authorising provision These Regulations are made under section 71 of the Fundraising Appeals Act 1998. -- 2 of 5 -- S.R. No. 83/1999 Fundraising Appeals Regulations 1999 2 3. Commencement (1) These Regulations, except regulation 7, come into operation on 1 July 1999. (2) Regulation 7 comes into operation on 1 October 1999. 4. Definition In these Regulations— "the Act" means the Fundraising Appeals Act 1998. 5. Activities not constituting a fundraising appeal For the purposes of section 5(3) of the Act, the following activities are not a fundraising appeal— (a) the soliciting or receipt of any money or benefit by, or on behalf of, a person or organisation in lieu of flowers being sent to a funeral or to the deceased person's family during the bereavement period; (b) the soliciting or receipt of any money or benefit by, or on behalf of, the deceased person's family for the benefit of a person or organisation in lieu of flowers being sent to a funeral or to the deceased person's family during the bereavement period. 6. Identifying badges For the purposes of section 9 of the Act, an identifying badge must prominently display— (a) the name and contact telephone number of the person or organisation conducting the fundraising appeal; and (b) the name of the person or organisation on whose behalf the fundraising appeal is being conducted; and r. 3 -- 3 of 5 -- S.R. No. 83/1999 Fundraising Appeals Regulations 1999 3 (c) the name of the collector required to wear the identifying badge; and (d) the words "valid to" and the date on which the collector's authority from the person or organisation conducting the fundraising appeal to participate in the fundraising appeal expires. 7. Labelling requirements for clothing bins (1) If all proceeds of the funds raised as a result of the donations to a clothing bin are received by an organisation that is a charity, the organisation must ensure, in addition to the requirements of section 10(1) of the Act, that the label on the clothing bin states— (a) that all the proceeds raised as a result of the donations to the clothing bin are received by an organisation that is a charity; and (b) the words "charity donation bin"; and (c) the address and telephone number of that organisation. Penalty: 20 penalty units. (2) If any part of the proceeds of the funds raised as a result of the donations to a clothing bin are received by any organisation that is not a charity, the organisation or organisations must ensure, in addition to the requirements of section 10(1) of the Act, that the label on the clothing bin states— (a) that part of the proceeds raised as a result of the donations to the clothing bin are received by an organisation that is not a charity; and (b) the words "commercial collection bin"; and r. 7 -- 4 of 5 -- S.R. No. 83/1999 Fundraising Appeals Regulations 1999 4 (c) the address and telephone number of that organisation or those organisations. Penalty: 20 penalty units. 8. Exemptions The Anti-Cancer Council of Victoria is exempt from complying with Part 3 of the Act. 9.
