No. 34/1999 Livestock Disease Control Act 1994 Livestock Disease Control (Identification) Regulations 1999 The Governor in Council makes the following Regulations: Dated: 30 March 1999 Responsible Minister: PATRICK McNAMARA Minister for Agriculture and Resources SHANNON DELLAMARTA Acting Clerk of the Executive Council 1. Objective The objective of these Regulations is to make further provision for the identification of cattle and pigs. 2. Authorising provision These Regulations are made under section 139 of the Livestock Disease Control Act 1994. 3. Commencement These Regulations come into operation on 1 April 1999. 4. Principal Regulations In these Regulations, the Livestock Disease Control Regulations 19951 are called the Principal Regulations. 5. New regulation 7 substituted -- 2 of 7 -- S.R. No. 34/1999 Livestock Disease Control (Identification) Regulations 1999 2 For regulation 7 of the Principal Regulations substitute— "7. Prescribed livestock to be identified (1) For the purposes of section 9 of the Act the prescribed livestock are cattle and pigs. (2) A pig must be identified with the tattoo brand or ear tag that sets out the number allocated by the Secretary identifying the property at which the pig was kept for 7 days before the application of the tag or tattoo and the particulars required by regulation 8. (3) Cattle— (a) must be identified by an ear or tail tag that sets out the number allocated by the Secretary identifying the property at which the cattle were kept for 7 days before the application of the tag and the particulars required by this Part; and (b) may also be identified, in accordance with regulation 8, by an ear tag that sets out the number allocated by the Secretary identifying the property of birth of the cattle or the property on which the cattle were kept at the time the tag was applied. (4) Cattle that are less than 6 weeks of age and accompanied by their dam when being sold are sufficiently identified for the purposes of section 9 of the Act if the accompanying dam is identified by an ear or tail tag in accordance with this Part. (5) If cattle or pigs are sold privately between persons and the cattle or pigs will remain on the property of the person who purchased the cattle or pigs for 30 days or more the cattle -- 3 of 7 -- S.R. No. 34/1999 Livestock Disease Control (Identification) Regulations 1999 3 or pigs are sufficiently identified for the purposes of section 9 of the Act if the cattle or pigs are accompanied by a document that identifies the cattle or pigs by breed, sex and age and the property number allocated by the Secretary to the seller.". 6. Ear and tail tags (1) In regulation 8(2) and (3) of the Principal Regulations omit ", with the authority of the Secretary,". (2) In regulation 8 of the Principal Regulations, for sub-regulations (5) and(6) substitute— "(5) Cattle that are one week of age or more and are to be moved from the property on which they were born may, before that removal and in addition to any other tag required by this Part, have attached an ear tag that complies with the requirements of Part J of Schedule 3. (6) Cattle that are one week of age or more that have been moved from the property on which they were born to another property where they are to be kept and that do not have a tag referred to in sub-regulation (5), may have attached an ear tag that complies with the requirements of Part K of Schedule 3.". 7. Manufacture of tags Regulation 11 of the Principal Regulations is revoked. 8. Removal of tags r. 6 -- 4 of 7 -- S.R. No. 34/1999 Livestock Disease Control (Identification) Regulations 1999 4 (1) In regulation 12(2) of the Principal Regulations, after "remove the tags" insert "(except a tag referred to in regulation 7(3)(b))". (2) In regulation 12(3) of the Principal Regulations, after "remove the ear tags" insert "(except a tag referred to in regulation 7(3)(b))". (3) For regulation 12(4) of the Principal Regulations substitute— "(4) A person must not remove any tag referred to in regulation 7(3)(b) unless— (a) the cattle are being slaughtered and the tag is removed by a person who is working at the place of slaughter; or (b) in any other case by, or at the direction of, an inspector. Penalty: 5 penalty units.". (4) Regulation 12(7) of the Principal Regulations is revoked. 9. New forms of cattle ear tags In Schedule 3 to the Principal Regulations, after Part I insert— "Part J Requirements for ear tags to be applied to cattle prior to removal from property on which the cattle were born A white plastic ear tag in the form of a circle that is— (a) marked with black lettering setting out— (i) the property identification number allocated by the Secretary to the cattle owner being the number 3 followed by 3 letters and 4 digits; and (ii) 3 letters allocated by the Secretary denoting the tag manufacturer, tag type and year of manufacture of the tag, followed by 4 digits; and -- 5 of 7 -- S.R. No. 34/1999 Livestock Disease Control (Identification) Regulations 1999 5 (b) embedded with a microchip encoded with the information set out in paragraph (a). Part K Requirements for ear tags to be applied to cattle that are no longer on the property on which they were born and that do not carry a tag in the form of Part J. An orange plastic tag in the form of a circle that is— (a) marked with black lettering setting out— (i) the property identification number allocated by the Secretary to the cattle owner being the number 3 followed by 3 letters and 4 digits; and (ii) 3 letters allocated by the Secretary denoting the tag manufacturer, tag type and year of manufacture of the tag, followed by 4 digits; and (b) embedded with a microchip encoded with the information set out in paragraph (a).". ═══════════════ r. 9 -- 6 of 7 -- S.R.
