Melbourne City Link (Start-Up Period) Regulations
1999
The Lieutenant-Governor as the Governor's Deputy with the
advice of the Executive Council makes the following
Regulations:

1. Objectives
The objectives of these Regulations are—
(a) to prescribe the start-up period within the
meaning of Part 4 of the Melbourne City
Link Act 1995 and the date of
commencement of that period; and
(b) to prescribe the penalties payable in respect
of an offence against section 73(1) of that
Act committed during the start-up period for
which an infringement notice is issued.
2. Authorising provisions
These Regulations are made under sections 69, 82
and 118 of the Melbourne City Link Act 1995.

3. Definition
In these Regulations—
"Act" means Melbourne City Link Act 1995.
4. Prescribed period of start-up period and date of
commencement
For the purposes of the definition of "start-up
period" in section 69 of the Act—
(a) the prescribed period is 3 months from the
beginning of the prescribed date;
(b) the prescribed date is the date on which the
first notice published under section 71(1) of
the Act takes effect.
5. Prescribed penalty during start-up period
(1) The prescribed penalty under section 82(a) of the
Act for an offence committed during the start-up
period against section 73(1) of the Act for which
an infringement notice is issued under section 80
of the Act is—
(a) $25; or
(b) if 4 infringement notices for offences against
section 73(1) of the Act have been issued in
respect of a person, for each further offence
against that section for which an
infringement notice is issued in respect of
that person, $100.
(2) For the purposes of sub-regulation (1)(b), the
number of infringement notices for offences
against section 73(1) of the Act that have been
issued in respect of a person during the start-up
period includes an infringement notice—
(a) that is withdrawn under section 83 of the
Act; or

(b) that is issued in respect of a person who
supplies a sworn statement in writing or a
statutory declaration under section 87(3) of
the Act in relation to the person who was
driving the vehicle at the relevant time.
