No. 17/1999 Road Safety Act 1986 Road Safety (Driving Instructors) Regulations 1999 The Governor in Council makes the following Regulations: Dated: 23 February 1999 Responsible Minister: GEOFF CRAIGE Minister for Roads and Ports MATTHEW GROVES Acting Clerk of the Executive Council 1. Objective The objective of these Regulations is to make provision with respect to driving instructor authorities. 2. Authorising provision These Regulations are made under section 95 of the Road Safety Act 1986. 3. Commencement These Regulations come into operation on 1 March 1999. 4. Definitions In these Regulations— "Act" means the Road Safety Act 1986; "authority" means driving instructor authority under section 33(1) of the Act; -- 2 of 5 -- S.R. No. 17/1999 Road Safety (Driving Instructors) Regulations 1999 2 "Secretary" means Secretary to the Department of Infrastructure. 5. Driving instructor authorities (1) The Secretary may require an applicant for an authority to complete an application form provided by the Secretary and to give to the Secretary the completed form accompanied by 2 recent passport size colour photographs of a full front view of the head and shoulders of the applicant on a white background. (2) The Secretary may require an applicant to pay a fee of $10 for every month of the term for which the Secretary proposes to grant an authority. 6. Return of driving instructor authority The holder of an authority must immediately return his or her authority to the Secretary if the authority is cancelled or suspended or otherwise ceases to have effect 1 . Penalty: 2 penalty units. 7. Replacement of driving instructor authority that has been lost, stolen or destroyed The Secretary may grant a duplicate authority if he or she is satisfied that the authority has become illegible, altered or defaced or that it has been lost, stolen or destroyed. 8. Display of driving instructor authority When teaching a person to drive a motor vehicle of a kind described in section 33(3) of the Act on a highway for financial gain or in the course of any trade or business, the holder of an authority must display his or her authority so that it is clearly visible to a person seated in either the driver seat or front passenger seat. 9. Production of driving instructor authority r. 5 r. 9 -- 3 of 5 -- S.R. No. 17/1999 Road Safety (Driving Instructors) Regulations 1999 3 When teaching a person to drive a motor vehicle of a kind described in section 33(3) of the Act on a highway for financial gain or in the course of any trade or business, the holder of an authority must produce his or her authority for inspection if requested to do so by a person authorised in writing by the Secretary for the purposes of this regulation. Penalty: 2 penalty units. 10. Records It is a condition of every authority that the holder— (a) keeps such records as are required by the Secretary; (b) produces all records referred to in paragraph (a) when requested to do so by a person authorised in writing by the Secretary for the purposes of this regulation and allows that person to make copies of the records; (c) notifies the Secretary of any change in the information provided by the holder in an application for the authority and that is shown on the authority and returns the authority to the Secretary for amendment within 7 days of the change occurring. ═══════════════ -- 4 of 5 -- S.R. No. 17/1999 Road Safety (Driving Instructors) Regulations 1999 4 NOTES 1 Reg. 6: Section 33(10) of the Act provides that the Secretary may, if of the opinion that the holder of an authority is unfit to hold the authority, by notice in writing to the holder of the authority, cancel the authority or suspend or vary the authority for such period as the Secretary determines.
