No. 123/1999 Transport Act 1983 Transport (Road Rules - Consequential Amendment) Regulations 1999 The Governor in Council makes the following Regulations: Dated: 23 November 1999 Responsible Minister: PETER BATCHELOR Minister for Transport HELEN DOYE Clerk of the Executive Council 1. Objectives The objectives of these Regulations are— (a) to make consequential amendments to the Transport (Roads and Property) Regulations 1993 and the Transport (Tow Truck) Regulations 1994 because of the introduction of the Road Rules; and (b) to make other minor amendments. 2. Authorising provisions These Regulations are made under sections 56, 185 and 256 of the Transport Act 1983. 3. Commencement These Regulations come into operation on 1 December 1999. 4. Transport (Roads and Property) Regulations 1993 -- 2 of 5 -- S.R. No. 123/1999 Transport (Road Rules - Consequential Amendment) Regulations 1999 2 (1) In regulation 5(1) of the Transport (Roads and Property) Regulations 19931 , after the definition of "road" insert— ' "Road Rules" has the same meaning as in the Road Safety (Road Rules) Regulations 1999;'. (2) In regulation 5 of the Transport (Roads and Property) Regulations 1993, for sub-regulation (2) substitute— "(2) A word or phrase used in Part 3 and in the Road Rules that is not defined in these Regulations, but is defined in the Road Rules, has the same meaning as in the Road Rules.". (3) In regulation 13 of the Transport (Roads and Property) Regulations 1993— (a) in sub-regulation (2), omit "or cyclist"; (b) in sub-regulation (4)— (i) in paragraph (c), omit "a cycle,"; (ii) in paragraph (e), omit "or cyclist". (4) In regulation 25(1)(c) of the Transport (Roads and Property) Regulations 1993, omit "or" (where secondly occurring). (5) In regulation 30(1)(a) of the Transport (Roads and Property) Regulations 1993, for "the Road Safety (Traffic) Regulations 1988" substitute "Part 12 of the Road Rules". 5. Transport (Tow Truck) Regulations 1994 In Schedule 4 to the Transport (Tow Truck) Regulations 1994 2 — (a) for "RS (P) R—Road Safety (Procedures) Regulations 1988" substitute "RS (G) R— Road Safety (General) Regulations 1999"; -- 3 of 5 -- S.R. No. 123/1999 Transport (Road Rules - Consequential Amendment) Regulations 1999 3 (b) for "RS (T) R—Road Safety (Traffic) Regulations 1988" substitute "RS (RR) R— Road Safety (Road Rules) Regulations 1999"; (c) in Column 2, for "RS (T) R 1609" substitute "RS (RR) R 603"; (d) in the heading of Column 4, for "RS (P) R Schedule 6" substitute "RS (G) R Schedule 4"; (e) in the description of the Offence in Column 1 opposite the Code Reference 4427 in Column 4, for "repair" substitute "rectification". ═══════════════ r. 5 -- 4 of 5 -- S.R.
