No. 105/1998 Control of Weapons Act 1990 Control of Weapons (Amendment) Regulations 1998 The Governor in Council makes the following Regulations: Dated: 18 August 1998 Responsible Minister: BILL McGRATH Minister for Police and Emergency Services STACEY ROBERTSON Acting Clerk of the Executive Council 1. Objective The objective of these Regulations is to amend the Principal Regulations— (a) to classify particular kinds of weapons as prescribed weapons; and (b) to change the list of regulated weapons. 2. Authorising provision These Regulations are made under section 12(1) of the Control of Weapons Act 1990. 3. Principal Regulations In these Regulations, the Control of Weapons Regulations 1990 1 are called the Principal Regulations. -- 2 of 5 -- S.R. No. 105/1998 Control of Weapons (Amendment) Regulations 1998 2 4. Commencement (1) Subject to sub-regulation (2), these Regulations come into operation on 24 August 1998. (2) Sub-regulation 5(2) comes into operation on 23 November 1998. 5. Amendment of regulation 4 (1) For regulation 4(b)(i) of the Principal Regulations substitute— "(i) a flat blade, exceeding 8 cm in length, with cutting edges (whether serrated or not serrated) along the length of both sides;". (2) In regulation 4 of the Principal Regulations, after paragraph (h) insert— '(ha) Hand-held battery-operated articles commonly known as "laser pointers" designed or adapted to emit a laser beam with an accessible emission limit of greater than 1 mW;'. (3) For regulation 4 (k) of the Principal Regulations substitute— '(k) A— (i) catapult, shanghai or hunting sling (without arm brace as described under paragraph (j)); or (ii) dart projector (for example an article commonly known as the "Darchery Dartslinger") or any similar device; or (iii) slingshot— which is manufactured and intended for commercial distribution;'. (4) In regulation 4 of the Principal Regulations, for paragraph (l) substitute— r. 4 -- 3 of 5 -- S.R. No. 105/1998 Control of Weapons (Amendment) Regulations 1998 3 '(l) An article designed or adapted to discharge oleoresin capsicum spray; (m) An article designed or adapted to emit or discharge an offensive, noxious or irritant liquid, powder, gas or chemical so as to cause disability, incapacity or harm to another person; (n) An article designed or adapted to emit an electric current into a human body for the purposes of incapacitation or injury; (o) A crossbow that— (i) is reasonably capable of being carried or concealed about the person; and (ii) is reasonably capable of being raised and discharged by one hand; (p) "Extendable baton": which means a baton designed or adapted so that the length of the baton extends by gravity or centrifugal force or by any pressure applied to a button, spring or device in or attached to the handle of the baton.'. 6. Amendment of regulation 5 (1) In regulation 5 of the Principal Regulations, omit paragraphs (d), (s) and (t). (2) In regulation 5(a) of the Principal Regulations, after "arrow" insert ", other than any type of crossbow classified as a prescribed weapon under regulation 4". (3) In regulation 5(p) of the Principal Regulations, after "Sword" insert "or bayonet". ═══════════════ r. 6 -- 4 of 5 -- S.R.
