No. 154/1998 Dangerous Goods Act 1985 Dangerous Goods (Storage and Handling) (Amendment) Regulations 1998 The Governor in Council makes the following Regulations: Dated: 1 December 1998 Responsible Minister: ROGER M. Objective The objective of these Regulations is to amend the Dangerous Goods (Storage and Handling) Regulations 1989 with respect to the transfer of liquefied gases, to clarify filling restrictions and procedures and to ensure consistency with provisions for the transport of dangerous goods. 2. Authorising provisions These Regulations are made under section 52 of the Dangerous Goods Act 1985. 3. Revocation of Regulations The Dangerous Goods (Liquefied Gases Transfer) Regulations 1987 1 are revoked. -- 2 of 6 -- S.R. Principal Regulations In these Regulations, the Dangerous Goods (Storage and Handling) Regulations 19892 are called the Principal Regulations. 5. Amendment to definitions In Regulation 107 of the Principal Regulations (a) in the definition of "packaging", for paragraphs (b) and (c) substitute "(b) in relation to dangerous goods of another class, means dangerous goods in a container with a capacity of not more than 450 litres and a net mass of not more than 400 kilograms;"; (b) for the definition of "storage in bulk", substitute ' "storage in bulk" means the storage of dangerous goods in containers that are not packaging;'; (c) in the definition of "transport tank", after "road" insert "or rail". 6. Amendment to Regulation 503 In Regulation 503 of the Principal Regulations, after "constructed," insert "filled,". 7. Amendments relating to transfer and filling restrictions After Regulation 509 of the Principal Regulations, insert "509A. Restrictions on transfer equipment A person must not use for the transfer of liquefied gas any pump, compressor, piping system or hose which is not designed, constructed and tested as being suitable for r. 4 -- 3 of 6 -- S.R. No. 154/1998 Dangerous Goods (Storage and Handling) (Amendment) Regulations 1998 3 the particular gas and the maximum internal pressure liable to be reached. 509B. Tank filling limitations (1) A person transferring liquefied gas from any source into a tank must ensure the maximum permitted filling ratio specified in Table 10.1 of the Transport Code is not exceeded. (2) Where no ratio is specified in Table 10.1 of the Transport Code, the Authority may approve the maximum permitted filling ratio. 509C. Conditions for filling by volume A person transferring liquefied gas into a bulk container must ensure the bulk container is not filled by volume unless (a) the fixed liquid level gauge is opened before the permitted filling level is reached (in which case filling must stop immediately); or (b) a variable liquid level gauge is used to ensure that the maximum permitted filling ratio for the particular liquefied gas specified in Table 10.1 of the Transport Code is not exceeded.". 8. Amendment in relation to liquid level gauges After Regulation 522 of the Principal Regulations, insert "522A. Liquid level gauges (1) Except as provided in sub-regulation (2), a person must not use a container for toxic liquefied gas if the container is fitted with (a) a fixed liquid level gauge; or r. 8 -- 4 of 6 -- S.R. No. 154/1998 Dangerous Goods (Storage and Handling) (Amendment) Regulations 1998 4 (b) a variable liquid level gauge which, when operated, discharges gas to the atmosphere. (2) Sub-regulation (1) does not apply to a tank used for liquefied ammonia.". 9. Amendment to Schedule 2 In Schedule 2 to the Principal Regulations, in clause 2, for sub-paragraph (iii) of the definition of "D" in the formula, substitute "(iii) the number of litres of liquid and kilograms of solid dangerous goods of Classes 3.2, 4.1, 4.2, 4.3, 5.1 and 8 of packaging groups III, Class 9 in packages and Class 2 aerosols.". ═══════════════ r. 9 -- 5 of 6 -- S.R.
