No. 4/1998 Equipment (Public Safety) Act 1994 Equipment (Public Safety) (General) (Amendment) Regulations 1998 The Governor in Council makes the following Regulations: Dated: 20 January 1998 Responsible Minister: ROGER M. Objective The objective of these Regulations is to amend the Equipment (Public Safety) (General) Regulations 1995 to alter certain references as a result of amendments made under the Accident Compensation (Occupational Health and Safety) Act 1996. 2. Authorising provision These Regulations are made under section 36 of the Equipment (Public Safety) Act 1994. 3. Principal Regulations In these Regulations, the Equipment (Public Safety) (General) Regulations 19951 are called the Principal Regulations. -- 2 of 5 -- S.R. Amendment of definitions In regulation 104 of the Principal Regulations— (a) after the definition of "administrative controls" insert— ' "agency" means a person or body that has the power under the law of the Commonwealth of Australia or the law of an Australian State or Territory to require design notification or registration of prescribed equipment in a manner which is reasonably equivalent to the requirements under Part 8 of these Regulations;'; and (b) for the definition of "Authority" substitute— ' "Authority" means the Victorian WorkCover Authority established under section 18 of the Accident Compensation Act 1985;'; and (c) in the definition of "published technical standard", for "Authority" substitute "agency". 5. Amendment of Principal Regulations In the Principal Regulations— (a) in regulations 106, 307, 404, 607, 801, 802 and 805(2) for "Minister" (wherever occurring) substitute "Authority"; and (b) in regulation 106(5), for "Minister's" substitute "Authority's"; and (c) in regulation 804 and 805(2) for "Authority" substitute "agency"; and r. 4 -- 3 of 5 -- S.R.
