No. 41/1998 Freedom of Information Act 1982 Freedom of Information Regulations 1998 The Governor in Council makes the following Regulations: Dated: 15 April 1998 Responsible Minister: JAN WADE Attorney-General SHARNE BRYAN Clerk of the Executive Council 1. Objectives The objectives of these Regulations are— (a) to declare certain bodies to be prescribed authorities for the purposes of the Freedom of Information Act 1982; (b) to prescribe certain offices for the purposes of section 5(3)(a) of that Act. 2. Authorising provisions These Regulations are made under sections 5 and 66 of the Freedom of Information Act 1982. 3. Revocation The following regulations are revoked— (a) the Freedom of Information (Prescribed Authorities) Regulations 1993 1 ; -- 2 of 6 -- S.R. No. 41/1998 Freedom of Information Regulations 1998 2 (b) the Freedom of Information (Exempt Offices) (Interim) Regulations 19972 . 4. Definition In these Regulations— "the Act" means the Freedom of Information Act 1982. 5. Prescribed authorities In accordance with paragraph (b) of the definition of "prescribed authority" in section 5(1) of the Act, each body and each body in a class of bodies specified in the Schedule is declared to be a prescribed authority for the purposes of the Act. 6. Exempt offices For the purposes of section 5(3)(a) of the Act the following are prescribed offices— (a) the office of Director of Public Prosecutions; (b) the office of Electoral Commissioner; (c) the office of Legal Ombudsman; (d) the office of Ombudsman; (e) the office of Public Advocate; (f) the office of Regulator-General referred to in section 14 of the Office of the Regulator- General Act 1994; (g) the office of Solicitor-General. __________________ r. 4 -- 3 of 6 -- S.R.
