No. 29/1997 Cemeteries Act 1958 Cemeteries (Incorporation of Trusts) (Amendment) Regulations 1997 The Governor in Council makes the following Regulations: Dated: 8 April 1997 Responsible Minister: ROB KNOWLES Minister for Health SHARNE BRYAN Clerk of the Executive Council 1. Objectives The objectives of these Regulations are to incorporate 2 additional cemetery trusts, abolish 3 cemetery trusts, change the name of cemetery trusts and amend the description of certain public cemeteries administered by cemetery trusts. 2. Authorising provisions These Regulations are made under sections 3, 4A and 92 of the Cemeteries Act 1958. 3. Principal Regulations In these Regulations the Cemeteries (Incorporation of Trusts) Regulations 19951 are called the Principal Regulations. -- 2 of 7 -- S.R. No. 29/1997 Cemeteries (Incorporation of Trusts) (Amendment) Regulations 1997 2 4. Amendment of regulation 4 (1) In regulation 4 of the Principal Regulations, before "Section 4A" insert "(1)". (2) At the end of regulation 4 of the Principal Regulations insert— "(2) Section 4A of the Cemeteries Act 1958 also applies to The Sheep Hills Cemetery Trust in respect of Sheep Hills Cemetery and The Woodside Cemetery Trust in respect of Woodside Cemetery.". 5. Additional cemetery trusts incorporated In the Schedule to the Principal Regulations— (a) after the item relating to Seymour Public Cemetery insert— "The Sheep Hills Cemetery Trust Sheep Hills Cemetery"; (b) after the item relating to Woodend Public Cemetery insert— "The Woodside Cemetery Trust Woodside Cemetery"; 6. Abolition of cemetery trusts (1) A cemetery trust listed in column 1 of the table is abolished and all its assets and liabilities are transferred to the cemetery trust listed in column 2 of the table opposite the first cemetery trust. r. 4 -- 3 of 7 -- S.R. (3) In the Schedule to the Principal Regulations, in Column 2 omit— (a) "Glendaruel Public Cemetery"; (b) "Krambruk Public Cemetery"; (c) "Molesworth Public Cemetery". 7. Change of name of cemetery trusts (1) In the Schedule to the Principal Regulations, in Column 1— (a) for "The Trustees of the Ballarat General Cemeteries" substitute "The Ballaarat General Cemeteries Trust"; (b) for "The Trustees of the Cheltenham Cemeteries Trust" substitute "The Cheltenham & Regional Cemeteries Trust"; r. 7 -- 4 of 7 -- S.R. No. 29/1997 Cemeteries (Incorporation of Trusts) (Amendment) Regulations 1997 4 (c) for "The Trustees of the Seymour Public Cemetery" substitute "The Seymour Cemeteries Trust"; (d) omit "Trustees of the" wherever else occurring, except in "Trustees of the Fawkner Crematorium and Memorial Park", "Trustees of the Lilydale Memorial Park and Cemetery" and "Trustees of the Memorial Park"; (e) for "Public Cemetery" (wherever else occurring) substitute "Cemetery Trust". (2) A cemetery trust the name of which is changed by sub-regulation (1) is the same body after as before the change of name. 8. Amendment of description of public cemeteries In the Schedule to the Principal Regulations, in Column 2— (a) for "Apollo Bay Public Cemetery" substitute "Apollo Bay (Krambruk) Public Cemetery"; (b) for "Bunerong Memorial Park" substitute "Bunurong Memorial Park"; (c) for "Cathkin Public Cemetery" substitute "Cathkin (Molesworth) Public Cemetery"; (d) after "Coburg Public Cemetery" insert "(Coburg Pioneer Memorial Park)"; (e) for "Coghill's Creek Public Cemetery" substitute "Coghill's Creek (Glendaruel) Public Cemetery"; (f) after "Northcote Public Cemetery" insert "(Northcote Pioneer Memorial Park)"; (g) after "Oakleigh Public Cemetery" insert "(Oakleigh Pioneer Memorial Park)"; r. 8 -- 5 of 7 -- S.R.
