No. 122/1997 Education Act 1958 Education (Maintenance Allowance Payments) Regulations 1997 The Governor in Council makes the following Regulations: Dated: 5 November 1997 Responsible Minister: PHILLIP GUDE Minister for Education SHARNE BRYAN Clerk of the Executive Council 1. Objective The objective of these Regulations is to make further provision for the payment of education maintenance allowances. 2. Authorising provision These Regulations are made under section 82 of the Education Act 1958. 3. Education maintenance allowances (1) In regulation 11.4(8) of the Education Regulations 19881 , after "this regulation," insert "and on the recommendation of the Chief Executive,". (2) For regulation 11.4(10) of the Education Regulations 1988 substitute— "(10) The Chief Executive may, for the purposes of sub-regulation (8), recommend that an -- 2 of 4 -- S.R. No. 122/1997 Education (Maintenance Allowance Payments) Regulations 1997 2 education maintenance allowance in respect of a person be paid— (a) wholly to the applicant; or (b) wholly to the school the person attends; or (c) in the proportions that are determined by the Chief Executive, partly to the applicant and partly to the school the person attends. (11) If the Chief Executive recommends that the whole or a part of an education maintenance allowance is payable to the school, the whole or the part of the allowance must be used for the direct benefit of the person.". ═══════════════ r. 3 -- 3 of 4 -- S.R.
