No. 14/1997 Health Act 1958 Health (Radiation Safety) (Amendment) Regulations 1997 The Governor in Council makes the following Regulations: Dated: 25 February 1997 Responsible Minister: ROB KNOWLES Minister for Health A. Objective The main objective of these Regulations is to facilitate the transfer of responsibility for the licensing of radiographers and nuclear medicine technologists to the Medical Radiation Technologists Board of Victoria. 2. Authorising provisions These Regulations are made under sections 108AJ and 391 of the Health Act 1958. 3. Commencement These Regulations come into operation on 1 March 1997. -- 2 of 6 -- S.R. Principal Regulations In these Regulations, the Health (Radiation Safety) Regulations 19941 are called the Principal Regulations. 5. Amendment of definition In regulation 4 of the Principal Regulations, for the definition of "licensee" substitute— ' "licensee" means a person issued with a licence under section 108AF of the Act and includes a person registered by the Medical Radiation Technologists Board of Victoria to practice in radiography or nuclear medicine technology;'. 6. Operator licences In regulation 11 of the Principal Regulations— (a) paragraphs (b), (d), and (f) are revoked; (b) in paragraph (g), before "medical" insert "registered"; (c) in paragraph (m), for "paragraphs (a) to (l)" substitute "paragraphs (a), (c), (e), (j), (k) and (l)". 7. Exemption from licensing Regulation 21 of the Principal Regulations is amended as follows— (a) in sub-regulation (1)— (i) for "licensed operator" substitute "the holder of an operator licence or a person registered by the Medical Radiation Technologists Board of Victoria"; (ii) for paragraph (b) substitute— r. 4 -- 3 of 6 -- S.R. No. 14/1997 Health (Radiation Safety) (Amendment) Regulations 1997 3 "(b) a person who is a student in radiography or nuclear medicine technology, and who is a trainee in medical imaging technology, radiation therapy technology, or nuclear medicine technology; and (ba) a person who is provisionally registered by the Medical Radiation Technologists Board of Victoria;"; (b) in sub-regulation (4), after "regulation 11" insert "or to a person registered by the Medical Radiation Technologists Board of Victoria". 8. New regulation 49 substituted For regulation 49 of the Principal Regulations substitute— "49. Use of ancillary equipment and procedures A person who is— (a) licensed to operate or use ionizing radiation apparatus or a radioactive substance for the purposes of medical diagnosis or treatment; or (b) registered by the Medical Radiation Technologists Board of Victoria and operating or using ionising radiation apparatus or a radioactive substance for the purposes of medical diagnosis or treatment— must use all procedures and ancillary equipment appropriate to the diagnosis or treatment to minimise the radiation dose to the person being diagnosed or treated. Personal monitoring For regulation 53(1)(a) of the Principal Regulations substitute— "(a) a licensee; or". 10. Radiation weighting factors In Part 1 of Schedule 3 to the Principal Regulations— (a) for "2 MeV Alpha particles, fission" substitute "2 MeV"; (b) for "fragments, heavy nuclei" substitute "Alpha particles, fission fragments, heavy nuclei". ═══════════════ r. 9 -- 5 of 6 -- S.R.
