No. 2/1997 Listening Devices Act 1969 Listening Devices Regulations 1997 The Governor in Council makes the following Regulations: Dated: 21 January 1997 Responsible Minister: JAN WADE Attorney-General A. WILTSHIRE Acting Clerk of the Executive Council 1. Objective The objective of these Regulations is to prescribe the circumstances in which the County Court or the Magistrates' Court may exercise the powers of the Supreme Court under section 4A of the Listening Devices Act 1969. 2. Authorising provisions These Regulations are made under sections 4A(8) and 9 of the Listening Devices Act 1969. 3. Revocation The Listening Devices Regulations 19871 are revoked. 4. Definition In these Regulations, "metropolitan municipal district" has the same meaning as in the Public Holidays Act 1993. -- 2 of 4 -- S.R. No. 2/1997 Listening Devices Regulations 1997 2 5. Prescribed circumstances The powers of the Supreme Court under section 4A of the Listening Devices Act 1969 may be exercised— (a) by the County Court if— (i) the warrant is to authorise the installation of a listening device on premises, or the use of a listening device at a place, being premises or a place not within a metropolitan municipal district; and (ii) the County Court is satisfied that it is not practicable for the complaint to be made to the Supreme Court; or (b) by the Magistrates' Court if— (i) the warrant is to authorise the installation of a listening device on premises, or the use of a listening device at a place, being premises or a place not within a metropolitan municipal district; and (ii) the Magistrates' Court is satisfied that it is not practicable for the complaint to be made to the Supreme Court or the County Court. ═══════════════ r. 5 -- 3 of 4 -- S.R.
