No. 136/1997 Lotteries Gaming and Betting Act 1966 Lotteries Gaming and Betting (Corresponding Offences) Regulations 1997 The Governor in Council makes the following Regulations: Dated: 25 November 1997 Responsible Minister: TOM REYNOLDS Minister for Sport SHARNE BRYAN Clerk of the Executive Council 1. Objective The objective of these Regulations is to declare certain laws of other States and Territories to be laws that correspond to section 18, 23 or 66B of the Lotteries Gaming and Betting Act 1966. 2. Authorising provision These Regulations are made under section 86 of the Lotteries Gaming and Betting Act 1966. 3. Definition In these Regulations, "Act" means Lotteries Gaming and Betting Act 1966. -- 2 of 4 -- S.R. No. 136/1997 Lotteries Gaming and Betting (Corresponding Offences) Regulations 1997 2 4. Corresponding laws for the purposes of section 18(1A) of the Act For the purposes of section 18(1A) of the Act, the following laws are declared to be laws that correspond to section 18 of the Act— (a) section 19(1) of the Games Wagers and Betting-houses Act 1901 of New South Wales in its application in the Australian Capital Territory; (b) section 44(1) of the Gaming and Betting Act 1912 of New South Wales; (c) section 26 of the Unlawful Betting Act 1989 of the Northern Territory of Australia; (d) section 233(1A) of the Criminal Code Act 1899 of Queensland; (e) section 218 of the Racing and Betting Act 1980 of Queensland in respect of a contravention of section 216(1) of that Act ; (f) section 75 of the Lottery and Gaming Act 1936 of South Australia; (g) section 76 of the Lottery and Gaming Act 1936 of South Australia; (h) section 95(1) of the Racing and Gaming Act 1952 of Tasmania; (i) section 41(3) of the Gaming Commission Act 1987 of Western Australia. 5. Corresponding laws for the purposes of section 23(2) of the Act For the purposes of section 23(2) of the Act, the following laws are declared to be laws that correspond to section 23 of the Act— r. 4 -- 3 of 4 -- S.R. No. 136/1997 Lotteries Gaming and Betting (Corresponding Offences) Regulations 1997 3 (a) section 18(1) of the Gaming and Betting Act 1906 of New South Wales in its application in the Australian Capital Territory; (b) section 5(1) of the Gaming and Betting Act 1912 of New South Wales; (c) section 29 of the Unlawful Betting Act 1989 of the Northern Territory of Australia; (d) section 218 of the Racing and Betting Act 1980 of Queensland in respect of a contravention of section 214 of that Act; (e) section 63 (1) of the Lottery and Gaming Act 1936 of South Australia; (f) section 99 of the Racing and Gaming Act 1952 of Tasmania; (g) section 24(1) of the Betting Control Act 1954 of Western Australia. 6. Corresponding laws for the purposes of section 66B(5) of the Act For the purposes of section 66B(5) of the Act, the following laws are declared to be laws that correspond to section 66B of the Act— (a) section 17C of the Gaming and Betting Act 1906 of New South Wales in its application in the Australian Capital Territory; (b) section 15C of the Gaming and Betting Act 1912 of New South Wales; (c) section 27(2) of the Unlawful Betting Act 1989 of the Northern Territory of Australia; (d) section 218 of the Racing and Betting Act 1980 of Queensland in respect of a contravention of section 217(1) of that Act. ═══════════════ r. 6 r. 6 -- 4 of 4 --
