No. 153/1997 Road Safety Act 1986 Road Safety (Road Rules – Give Way to Stock) Regulations 1997 The Governor in Council makes the following Regulations: Dated: 9 December 1997 Responsible Minister: GEOFF CRAIGE Minister for Roads and Ports SHARNE BRYAN Clerk of the Executive Council PART 1—PRELIMINARY 101. Objectives The objectives of these Regulations are— (a) to require drivers who have passed a prescribed sign to give way to an animal under control; and (b) to specify the obligations of drivers who come to a STOP sign erected at a point where animals under control cross the highway; and (c) to provide for the erection, display and removal of prescribed signs by persons accompanying an animal under control; and (d) to require drivers to travel at a safe speed where there are animals under control. -- 2 of 8 -- S.R. No. 153/1997 Road Safety (Road Rules – Give Way to Stock) Regulations 1997 2 102. Authorising provision These Regulations are made under section 95 of the Road Safety Act 1986. 103. Interpretation (1) In these Regulations— "animal under control" means an animal on a highway— (a) in accordance with the provisions of a permit issued by the council; or (b) being moved within a municipal district in circumstances such that a local law provides that a permit is not required; "council", in relation to a highway, means the council within the municipal district of which the highway is situated; "temporary stock crossing site" means a place at which animals under control cross a highway less than 52 times in any 12 month period. (2) For the purposes of these Regulations a sign is to be taken to be similar to Diagram 1 or 2 set out in regulation 201 despite— (a) the use of a reference to a particular kind of animal in place of the word "stock"; and (b) the use of a picture of that kind of animal in place of the pictures of a cow and a sheep. (3) For the purposes of these regulations a sign is to be taken as similar to Diagram 1 set out in regulation 201 despite the use of a different number in place of the number 5 and the use of the letter "m" (meaning metres) instead of the letters "km" (meaning kilometres). _______________ r. 102 -- 3 of 8 -- S.R. Giving way to stock (1) If a sign similar to Diagram 1 is erected or displayed on a highway to face the drivers of approaching vehicles, a driver of such a vehicle who passes the sign must take such action as is reasonably necessary to avoid a collision with any animal under control within the distance shown on the sign. Penalty: 5 penalty units BLACK Cow, sheep and words. WHITE Background. Diagram 1 (2) If a sign similar to Diagram 2 is erected or displayed on a highway to face the drivers of approaching vehicles, a driver of such a vehicle who is approaching or passes the sign must take such action as is reasonably necessary to avoid a collision with any animal under control at or near the sign. Requirement to travel at a safe speed A driver of a vehicle to whom regulation 201(1) or (2) applies must travel at a speed that would enable the driver to stop the vehicle safely if an animal under control were to move into the path of the vehicle. Penalty: 5 penalty units. 203. Requirement to stop at a stock crossing If a driver of a vehicle comes to a STOP sign similar to Diagram 3 at a place where animals under control cross a highway, the driver must stop the vehicle at a reasonable distance from that place and must not proceed while an animal is crossing at that place. Power to erect signs (1) Despite regulation 301 of the Road Safety (Traffic) Regulations 1988 1 , and provided the Guidelines for the Selection of Stock Crossing Sites, and the Placement of Signs when Stock are on Roads as published by the Roads Corporation from time to time, are followed— (a) a person accompanying an animal under control at a temporary stock crossing site may erect, display or remove signs similar to Diagram 2 set out in regulation 201(2) and signs similar to Diagram 4; and r. 202 -- 6 of 8 -- S.R. Diagram 4 (b) a person accompanying an animal under control while droving may erect, display or remove signs similar to Diagram 1 set out in regulation 201(1); and (c) a person responsible for an animal under control grazing on a highway may erect, display or remove signs similar to Diagram 1 set out in regulation 201(1) and signs similar to Diagram 4. ═══════════════ r. 204 -- 7 of 8 -- S.R.
