No. 151/1996 Australian Grands Prix Act 1994 Australian Grands Prix (Formula One) Regulations 1996 The Governor in Council makes the following Regulations: Dated: 17 December 1996 Responsible Minister: LOUISE ASHER Minister for Tourism A. WILTSHIRE Acting Clerk of the Executive Council 1. Objective The objective of these regulations is to regulate the conduct of persons in the declared area and designated access areas during the race period for the Australian Formula One Grand Prix and to facilitate, and ensure an appropriate degree of safety of persons in the declared area and designated access areas during, works for the Grand Prix. 2. Authorising provisions These regulations are made under sections 37 and 51 of the Australian Grands Prix Act 1994. 3. Definitions In these regulations— "Act" means the Australian Grands Prix Act 1994; -- 2 of 20 -- S.R. No. 151/1996 Australian Grands Prix (Formula One) Regulations 1996 2 "authorised person" means— (a) a person appointed by the Corporation to be an authorised person for the purposes of these regulations; or (b) a member of the police force; "entrance" includes a gate or turnstile; "exit" includes a gate or turnstile; "grand prix circuit" means the temporary race track established by the Corporation at Albert Park; "permitted entrant" means— (a) the holder of a valid ticket issued by or on behalf of the Corporation that entitles him or her to be within specific areas of the declared area in respect of a year or a designated access area; (b) a person who is admitted to the declared area in respect of a year or a designated access area by the Corporation or by an agent of the Corporation on payment of an admission fee; (c) any other person who is, under a general or specific authorisation granted by the Corporation, entitled to be in the declared area in respect of a year, or a designated access area; "reserved area" means an area within the declared area in respect of a year or a designated access area to which access is limited to persons holding certain types of tickets or to which access is otherwise restricted; "specified period", in respect of a year, means— r. 3 -- 3 of 20 -- S.R. No. 151/1996 Australian Grands Prix (Formula One) Regulations 1996 3 (a) in relation to the declared area in respect of that year, the period beginning 12 weeks before the start of the race period in respect of that year and ending 4 weeks after the end of that race period; (b) in relation to a designated access area, the period specified in any declaration under section 32A(1)(a) or (b) of the Act during which the area to which the declaration applies is a designated access area; "ticket" includes a pass, credential or other document; "vehicle" means a conveyance that is designed to be propelled or drawn by any means, whether or not capable of being so propelled or drawn; "works area" means an area in the declared area in respect of a year or in a designated access area, in which works, services, or any other activities undertaken by or on behalf of the Corporation have commenced but have not been finally completed. 4. Authorised persons (1) The Corporation may appoint persons to be authorised persons for the purposes of these regulations. (2) A person must not interfere with, obstruct or hinder an authorised person in the exercise of powers, functions or duties under these regulations. Penalty: 20 penalty units. 5. Identification r. 4 r. 5 -- 4 of 20 -- S.R. No. 151/1996 Australian Grands Prix (Formula One) Regulations 1996 4 (1) The Corporation must ensure that every authorised person appointed under regulation 4(1) is clearly identified as such. (2) An authorised person appointed under regulation 4(1) must, if requested by the person in relation to whom the authorised person is exercising or purporting to exercise any power under these regulations, produce his or her identification for the inspection of that person. Penalty: 10 penalty units. 6. Entry to and exit from declared area or designated access area (1) A person who is not a permitted entrant must not enter the declared area in respect of a year or a designated access area during the race period in respect of that year. Penalty: 20 penalty units. (2) A person must not enter the declared area in respect of a year or a designated access area during the race period in respect of that year except through an entrance established by the Corporation or as otherwise permitted by the Corporation. Penalty: 10 penalty units. (3) A person must not leave the declared area in respect of a year or a designated access area during the race period in respect of that year except through an exit established by the Corporation or as otherwise permitted by the Corporation. Re-entry after expulsion A person who, on any day during the race period in respect of a year, has been expelled from or requested to leave the declared area in respect of that year or a designated access area by an authorised person must not re-enter the declared area or a designated access area on that day without the written authorisation of the Corporation. Penalty: 20 penalty units. 8. Grand Prix circuit A person must not, at any time during the race period in respect of a year, be on the grand prix circuit unless authorised by the Corporation. Penalty: 20 penalty units. 9. Vehicles in declared area A person must not bring a vehicle into the declared area in respect of a year or a designated access area during the race period in respect of that year unless authorised by the Corporation. Penalty: 10 penalty units. 10. Opening and closing times (1) The Corporation must, by notice in a newspaper circulating generally in the State, fix an opening time and a closing time for each day of the race period in respect of a year for which tickets are issued to the general public. (2) A person must not be in the declared area in respect of that year or a designated access area before the opening time or after the closing time r. 7 -- 6 of 20 -- S.R. No. 151/1996 Australian Grands Prix (Formula One) Regulations 1996 6 fixed under sub-regulation (1) unless authorised by the Corporation. Penalty: 20 penalty units. 11. Reserved areas and reserved seats (1) The Corporation may, for the duration of the race period in respect of a year, set aside— (a) certain areas within the declared area in respect of that year or a designated access area as reserved areas; or (b) certain seats within the declared area in respect of that year or a designated access area as reserved seats. (2) The Corporation may issue tickets that entitle the ticket holder to— (a) enter and remain in a reserved area; or (b) occupy a reserved seat. (3) A person who does not hold a ticket conferring an entitlement to enter a reserved area must not enter or remain in a reserved area unless authorised by the Corporation. Penalty: 5 penalty units. (4) A person who does not hold a ticket conferring an entitlement to occupy a particular reserved seat must not occupy that reserved seat. Penalty: 5 penalty units. (5) An authorised person may expel any person from— (a) a reserved area; or (b) a reserved seat— if that person, on request by the authorised person, does not produce a ticket entitling the holder to r. 11 -- 7 of 20 -- S.R. No. 151/1996 Australian Grands Prix (Formula One) Regulations 1996 7 enter and remain in the reserved area or to occupy the reserved seat. (6) A person must not remove from a reserved area any glass object that has been obtained in that area unless authorised by the Corporation. Penalty: 5 penalty units. (7) An authorised person may direct a person to return any glass object that has been removed from a reserved area in contravention of sub- regulation (6). (8) If requested to return a glass object under sub- regulation (7), a person must, as soon as practicable, return the glass object to the reserved area where it was obtained. Penalty: 5 penalty units. 12. Alcohol (1) Subject to sub-regulation (2), a person must not bring an alcoholic beverage into the declared area in respect of a year or a designated access area during the race period in respect of that year. Penalty: 10 penalty units. (2) Sub-regulation (1) does not apply to— (a) a person who is acting under an authorisation granted by the Corporation; or (b) a servant or agent of a person referred to in paragraph (a) acting in the course of his or her duties. (3) During the race period in respect of a year, a person must not, without the authorisation of the Corporation, consume, sell or give to another person within the declared area in respect of that year or a designated access area any alcoholic beverage that has been brought into the declared r. 12 -- 8 of 20 -- S.R. No. 151/1996 Australian Grands Prix (Formula One) Regulations 1996 8 area or designated access area in contravention of these regulations. Penalty: 10 penalty units. 13. Items not to be brought into the declared area or a designated access area (1) During the race period in respect of a year, a person must not, without the authorisation of the Corporation, bring any of the following items into the declared area in respect of that year or a designated access area— (a) glass bottles or containers or other glass objects; (b) beverage containers with the manufacturer's seal broken; (c) drinks coolers or ice boxes (other than one predominantly constructed of polystyrene); (d) weapons or articles capable of being used as weapons; (e) chairs, lounges, benches or stools (other than a folding chair or folding stool); (f) animals (other than, if the person is blind, deaf or otherwise suffering a disability, a guide dog); (g) flags larger than 1 metre by 1 metre or with handles longer than 1 metre; (h) banners. Penalty: 5 penalty units. (2) During the race period in respect of a year, a person must not, without the authorisation of the Corporation, bring into the declared area in respect of that year or a designated access area anything which does not have an ordinary and reasonable use by that person within those areas r. 13 -- 9 of 20 -- S.R. No. 151/1996 Australian Grands Prix (Formula One) Regulations 1996 9 during that race period and which may be used to— (a) erect a structure; (b) deface or damage any structure within the declared area or a designated access area; (c) adversely affect the safety of the public within the declared area or a designated access area; (d) disrupt or interrupt any race, event or activity comprising a Formula One event; (e) interfere with the comfort of persons within the declared area or a designated access area or their enjoyment of a Formula One event; (f) distract, hinder or interfere with the driver of any vehicle or craft taking part in a Formula One event. Penalty: 20 penalty units. (3) An authorised person may, with reasonable cause, revoke any authorisation given under this regulation by or on behalf of the Corporation. (4) If an authorisation given under this regulation is revoked by notice given to a person, that person must either as soon as practicable remove or hand to an authorised person the item or, if requested by an authorised person, as soon as practicable leave the declared area or designated access area. Penalty: 5 penalty units. 14. Conduct within the declared area or designated access areas (1) During the race period in respect of a year, a person must not, within the declared area in respect of that year or a designated access area— r. 14 -- 10 of 20 -- S.R. No. 151/1996 Australian Grands Prix (Formula One) Regulations 1996 10 (a) misuse, deface, damage or tamper with any building, seat, chair, table, structure, vehicle, craft, truck, pipe, tap, tap fitting, conduit, electrical equipment, wiring or sign or excavate or cause to be excavated any part of the declared area or designated access areas unless authorised by the Corporation; (b) erect any structure, or erect or display any sign or banner, without the written authorisation of the Corporation; (c) block any stairs, steps, aisle, gangway, overpass, underpass, pontoon, bridge, passage, entry, exit or other thoroughfare unless authorised by the Corporation; (d) throw any stone, bottle or other missile; (e) disrupt, interrupt, or behave in any manner that may disrupt or interrupt, any race, event or activity comprising a Formula One event or disrupt, or interfere with, the comfort of persons or their enjoyment of a Formula One event unless authorised by the Corporation; (f) transmit by radio or television any part of a Formula One event without the written authorisation of the Corporation; (g) operate or use a loud hailer, public address system or other broadcast device or any other device that may interfere with electronic or radio communications unless authorised by the Corporation; (h) conduct public surveys or opinion polls, or solicit money, donations or subscriptions from members of the public without the written authorisation of the Corporation; r. 14 -- 11 of 20 -- S.R. No. 151/1996 Australian Grands Prix (Formula One) Regulations 1996 11 (i) act or conduct himself or herself in such a way as to adversely affect the safety of the public within the declared area or a designated access area; (j) act or conduct himself or herself in such a way as to distract, hinder or interfere with the driver of any vehicle or craft taking part in a Formula One event. Penalty: 20 penalty units. (2) During the race period in respect of a year, a person must not, within the declared area in respect of that year or a designated access area unless authorised by the Corporation— (a) enter or remain, or cause any other person to enter or remain, in the lake in Albert Park; (b) pick, injure, uproot any plant or any part of a plant or disturb or interfere with any fauna; (c) climb or remain on any tree or structure. Penalty: 5 penalty units. (3) An authorised person may cause to be dismantled or removed from the declared area, or designated access area, any structure built in contravention of this regulation. (4) An authorised person may, with reasonable cause, revoke any authorisation given under this regulation by or on behalf of the Corporation. (5) If an authorisation given under this regulation is revoked by notice given to a person, that person must either as soon as practicable cease the conduct or, if requested by an authorised person, as soon as practicable leave the declared area or designated access area. Penalty: 20 penalty units. r. 14 -- 12 of 20 -- S.R. No. 151/1996 Australian Grands Prix (Formula One) Regulations 1996 12 15. Inspection (1) During the race period in respect of a year, an authorised person may— (a) request a person to produce and open for inspection any bag, basket or other receptacle that the person intends to take into or has in the declared area in respect of that year or a designated access area; (b) request a person who has entered or intends to enter the declared area or a designated access area to turn out their pockets. (2) A person outside the declared area or a designated access area who refuses to comply with a request under sub-regulation (1) must not enter the declared area or designated access area during the race period. Penalty: 5 penalty units. (3) An authorised person may expel from the declared area or a designated access area a person who refuses to comply with a request under sub- regulation (1). 16. Surrender of prohibited items (1) An authorised person may request a person to surrender any item that— (a) has been brought into or remains in the declared area in respect of a year or a designated access area in contravention of regulation 12 or 13; or (b) is being used in a manner that contravenes regulation 14. (2) An authorised person may expel from the declared area or a designated access area a person who refuses to comply with a request under sub- regulation (1). r. 15 -- 13 of 20 -- S.R. No. 151/1996 Australian Grands Prix (Formula One) Regulations 1996 13 17. Prohibition of advertisements (1) During the race period in respect of a year, a person must not, without the written authorisation of the Corporation, cause any poster, placard, bill, banner, print, paper or any advertising material to be affixed to or placed on any structure, tree, fence or cordon that is within the declared area in respect of that year or a designated access area or on any fence, cordon or structure defining the boundary of the declared area or a designated access area. Penalty: 5 penalty units. (2) An authorised person may remove any poster, placard, bill, banner, print, paper or advertising material, affixed or placed on any structure, tree, fence or cordon in contravention of this regulation. (3) During the race period in respect of a year, a person must not, without the written authorisation of the Corporation— (a) distribute or promote any advertising or promotional material, samples of goods or services, or any other matter or thing; or (b) display any advertising or promotional material, samples of goods or services, or any other matter or thing (other than articles of clothing being worn)— to members of the public within the declared area in respect of that year or a designated access area. Penalty: 5 penalty units. (4) During the race period in respect of a year, an authorised person may, within the declared area in respect of that year or a designated access area, request a person to surrender any matter or thing r. 17 -- 14 of 20 -- S.R. No. 151/1996 Australian Grands Prix (Formula One) Regulations 1996 14 distributed, promoted or displayed in contravention of this regulation. (5) An authorised person may expel from the declared area or a designated access area a person who refuses to comply with a request made under sub- regulation (4). 18. Sale of goods or services (1) During the race period in respect of a year, a person must not, without the written authorisation of the Corporation, within the declared area in respect of that year or a designated access area— (a) hawk, sell, offer or expose for sale to members of the public any goods or services or collect money or orders from members of the public for goods or services; (b) sell, offer or make available for sale, or give away any ticket to the Grand Prix whether valid, an imitation or forged. Penalty: 20 penalty units. (2) During the race period in respect of a year, a person must not, without the written authorisation of the Corporation, bring into the declared area in respect of that year or a designated access area goods for the purpose of distribution or sale to members of the public. Penalty: 10 penalty units. (3) During the race period in respect of a year, an authorised person may request a person to surrender any item sold or being offered or exposed for sale in contravention of this regulation. r. 18 -- 15 of 20 -- S.R. No. 151/1996 Australian Grands Prix (Formula One) Regulations 1996 15 (4) An authorised person may expel a person from the declared area or a designated access area who refuses to comply with a request made under sub- regulation (3). 19. No smoking areas (1) During the race period in respect of a year, the Corporation may designate any part of the declared area in respect of that year or a designated access area as a no smoking area. (2) The Corporation must designate a no smoking area by appropriate markings and must post at or near the entrance to that area a notice or, if there is no defined entrance, notices at reasonable intervals throughout the area, bearing the words "NO SMOKING". (3) A person must not smoke in a no smoking area. Penalty: 5 penalty units. 20. Entertainment within declared area or designated access areas During the race period in respect of a year, a person must not— (a) conduct an entertainment within the declared area in respect of that year or a designated access area without being licensed to do so by the Corporation; or (b) if licensed by the Corporation to conduct an entertainment, contravene a condition of the licence. Penalty: 5 penalty units. 21. Safe and orderly conduct of works (1) During the specified period in respect of a year— r. 19 -- 16 of 20 -- S.R. No. 151/1996 Australian Grands Prix (Formula One) Regulations 1996 16 (a) a person must not, within the declared area in respect of that year or a designated access area act, or conduct himself or herself, in such a way as to obstruct, hinder, or endanger the safe and orderly carrying out of works, provision of services or undertaking of activities by or on behalf of the Corporation within the area; (b) a person must not enter or remain in a works area unless authorised to do so by the Corporation. Penalty: 20 penalty units. (2) If, during the specified period in respect of a year, an authorised person notifies a person of the safe distance from a works area, that person must immediately withdraw to that distance and must not approach any closer to the works area than that distance. Penalty: 20 penalty units. (3) In this regulation, "safe distance" means such reasonable distance from a works area as is indicated by an authorised person. 22. Regulation of entry during specified period (1) In addition to any other powers conferred by these regulations or any other laws, an authorised person may, during the specified period in respect of a year, request a person who within the declared area in respect of that year or a designated access area obstructs, hinders or endangers the carrying out of works, the provision of services or any other activity undertaken by or on behalf of the Corporation under the Act to leave the declared area or designated access area. r. 22 -- 17 of 20 -- S.R. No. 151/1996 Australian Grands Prix (Formula One) Regulations 1996 17 (2) A person requested under sub-regulation (1) to leave the declared area or designated access area must comply with the request. Penalty: 20 penalty units. (3) A person who is expelled from or asked to leave the declared area in respect of a year or a designated access area by an authorised person during the specified period in respect of that year must not re-enter any of those areas— (a) if it is the first occasion during that period on which the person has been expelled from or requested to leave the declared area or designated access area under sub-regulation (1)—until the expiration of 24 hours after the expulsion or request or the end of the specified period, whichever first occurs; (b) if it is the second occasion on which the person has been expelled from or requested to leave the declared area or designated access area—until the expiration of 7 days after the expulsion or request or the end of the specified period, whichever first occurs; (c) if it is the third or a subsequent occasion on which the person has been expelled from or requested to leave the declared area or designated access area—until the expiration of the specified period. Penalty: 20 penalty units. (4) Nothing in sub-regulation (3) prevents a person outside the race period in respect of a year— (a) driving a vehicle, or being a passenger in a vehicle being driven, on a public highway through the declared area or a designated access area; r. 22 -- 18 of 20 -- S.R. No. 151/1996 Australian Grands Prix (Formula One) Regulations 1996 18 (b) attending in the declared area or a designated access area— (i) a public entertainment; (ii) a public sporting activity— approved by the committee of management; (c) patronising a business that is permanently located in the declared area or a designated access area. 23. Prescribed fee The prescribed fee for the purposes of section 37 of the Act is $155 plus $10 for each day or part of a day during which the vehicle is kept in a convenient place by the Corporation. 24. Powers of authorised persons In addition to any other powers conferred by these regulations or any other laws, an authorised person may, during the race period in respect of a year— (a) prevent a person other than a permitted entrant entering the declared area in respect of that year or a designated access area; (b) prevent a person from entering the declared area in respect of that year or a designated access area otherwise than through an entrance established by the Corporation or as otherwise permitted by the Corporation; (c) request a person in the declared area in respect of that year or a designated access area to produce a ticket or other satisfactory evidence of that person’s entitlement to be or remain in the area; (d) prevent a person from leaving the declared area in respect of that year or a designated r. 23 -- 19 of 20 -- S.R. No. 151/1996 Australian Grands Prix (Formula One) Regulations 1996 19 access area otherwise than through an exit established by the Corporation or as otherwise permitted by the Corporation; (e) expel from the declared area in respect of that year or a designated access area a person who has unlawfully entered, who is not entitled to remain in, or who does not produce satisfactory evidence of their entitlement to be, or to remain, in the declared area or designated access area; (f) expel from the declared area in respect of that year or a designated access area a person who is found contravening these regulations; (g) refuse entry to the declared area in respect of a year or a designated access area to a person who is in possession of an item referred to in regulation 13. 25. Attempts A person who attempts to commit an offence under these regulations is guilty of the offence of attempting to commit that offence. ═══════════════ r. 25 -- 20 of 20 --
