No. 29/1996 Dangerous Goods Act 1985 Dangerous Goods (Amendment) Regulations 1996 The Governor in Council makes the following Regulations: Dated: 16 April 1996 Responsible Minister: MARK BIRRELL Minister for Industry, Science and Technology KATHY WILSON Clerk of the Executive Council PART 1—PRELIMINARY 1. Objectives The objective of these Regulations is to make amendments to the Dangerous Goods (Liquefied Gases Transfer) Regulations 19871 , the Dangerous Goods (Storage and Handling) Regulations 19892 and the Dangerous Goods (Transport) Regulations 19873 as a result of amendments made by the Dangerous Goods (Amendment) Act 1995. 2. Authorising provision These Regulations are made under section 52 of the Dangerous Goods Act 1985. _______________ -- 2 of 10 -- S.R. No. 29/1996 Dangerous Goods (Amendment) Regulations 1996 2 PART 2—AMENDMENTS TO THE DANGEROUS GOODS REGULATIONS Division 1—Dangerous Goods (Liquefied Gases Transfer) Regulations 1987 3. Amendment of definitions In regulation 4 of the Dangerous Goods (Liquefied Gases Transfer) Regulations 19874 — (a) for the definition of "Class" substitute— ' "Class" has the same meaning as it has in the Transport Code and includes any Class that is declared in an Order in Council made under section 9B of the Act;'; and (b) the definition of "dangerous goods" is revoked; and (c) for the definition of "Subsidiary Risk Category" substitute— ' "Subsidiary Risk Category" has the same meaning as "Subsidiary Risk" in the Transport Code;'. Division 2—Dangerous Goods (Storage and Handling) Regulations 1989 4. Definition of Principal Regulations In this Division the Dangerous Goods (Storage and Handling) Regulations 1989 5 are called the Principal Regulations. 5. Amendment of definitions In regulation 107 of the Principal Regulations— (a) for the definition of "Class" substitute— r. 3 -- 3 of 10 -- S.R. No. 29/1996 Dangerous Goods (Amendment) Regulations 1996 3 ' "Class" has the same meaning as it has in the Transport Code and includes any Class that is declared in an Order in Council made under section 9B of the Act;'; and (b) for the definition of "correct product name" substitute— ' "correct product name" has the same meaning as "Correct Shipping Name" in the Transport Code but does not include paragraphs (d), (e) or (f) of that meaning;'; and (c) the definition of "dangerous goods" is revoked; and (d) for the definition of "Hazchem Code" substitute— ' "Hazchem Code" has the same meaning as it has in the Transport Code;'; and (e) for the definition of "packaging group" substitute— ' "packaging group" has the same meaning as it has in the Transport Code;'; and (f) for the definition of "subsidiary risk" substitute— ' "subsidiary risk" has the same meaning as it has in the Transport Code;'; and (g) for the definition of "U.N No." substitute— ' "U.N No." has the same meaning as "United Nations (UN) Number" in the Transport Code;'. r. 5 -- 4 of 10 -- S.R. No. 29/1996 Dangerous Goods (Amendment) Regulations 1996 4 6. Classes of dangerous goods After regulation 107 of the Principal Regulations insert— " 107A. Classes of dangerous goods In these Regulations— (a) a reference to dangerous goods of Class 3 is a reference to dangerous goods of Class 3.1 and 3.2; and (b) a reference to dangerous goods of Class 3.1 is a reference to flammable liquids of Class 3 of Packaging Group I or II; and (c) a reference to dangerous goods of Class 3.2 is a reference to flammable liquids of Class 3 of Packaging Group III ; and (d) a reference to dangerous goods of Class 3.3 is a reference to combustible liquids of Class C1 in AS 1940; and (e) a reference to dangerous goods of Class 3.4 is a reference to combustible liquids of Class C2 in AS 1940; and (f) a reference to dangerous goods of Class R is a reference to— (i) dangerous goods listed as goods too dangerous to be transported in the Transport Code; and (ii) dangerous goods declared as Class R dangerous goods by an Order in Council made under section 9B of the Act.". r. 6 -- 5 of 10 -- S.R. No. 29/1996 Dangerous Goods (Amendment) Regulations 1996 5 7. Amendments to references to the Dangerous Goods (Prescribed List) Regulations 1986 (1) In regulation 606(1)(b) of the Principal Regulations, for "description of the goods in column 2 of Schedule 1 of the Dangerous Goods (Prescribed List) Regulations 1986" substitute "correct product name of the goods". (2) In regulation 606(2)(a) of the Principal Regulations, for "description of the goods in the Dangerous Goods (Prescribed List) Regulations 1986" substitute "correct product name of the goods". (3) In regulation 606(3)(a) of the Principal Regulations, for "description of the dangerous goods in the Dangerous Goods (Prescribed List) Regulations 1986" substitute "correct product name of the goods". 8. Amendments to Schedules (1) In items 2A(d) and 2B(d)(i) of Schedule 9 to the Principal Regulations, for "column 5 of the table in the Dangerous Goods (Prescribed List) Regulations 1986" substitute "the Transport Code". (2) In items 1 and 2(a) of Schedule 10 to the Principal Regulations, for "Schedule 1 of the Dangerous Goods (Prescribed List) Regulations 1986" substitute "the Transport Code". Division 3—Dangerous Goods (Transport) Regulations 1987 9. Amendment of definitions In regulation 104 of the Dangerous Goods (Transport) Regulations 1987 6 — (a) for the definition of "Class" substitute— r. 7 -- 6 of 10 -- S.R. No. 29/1996 Dangerous Goods (Amendment) Regulations 1996 6 ' "Class" has the same meaning as it has in the Transport Code and includes any Class that is declared in an Order in Council made under section 9B of the Act;'; and (b) the definition of "dangerous goods" is revoked; and (c) for the definition of "Subsidiary Risk Category" substitute— ' "Subsidiary Risk Category" has the same meaning as "Subsidiary Risk" in the Transport Code;'. 10. Classes of dangerous goods After regulation 104 of the Dangerous Goods (Transport) Regulations 1987 7 insert— "104A. Classes of dangerous goods In these Regulations— (a) a reference to dangerous goods of Class 3 is a reference to dangerous goods of Class 3.1 and 3.2; and (b) a reference to dangerous goods of Class 3.1 is a reference to flammable liquids of Class 3 of Packaging Group I or II; and (c) a reference to dangerous goods of Class 3.2 is a reference to flammable liquids of Class 3 of Packaging Group III; and (d) a reference to dangerous goods of Class 3.3 is a reference to combustible liquids of Class C1 in AS 1940; and (e) a reference to dangerous goods of Class 3.4 is a reference to combustible liquids of Class C2 in AS 1940; and r. 10 -- 7 of 10 -- S.R. No. 29/1996 Dangerous Goods (Amendment) Regulations 1996 7 (f) a reference to dangerous goods of Class R is a reference to— (i) dangerous goods listed as goods too dangerous to be transported in the Transport Code; and (ii) dangerous goods declared as Class R dangerous goods by an Order in Council made under section 9B of the Act.".
