Guardianship and Administration Board (Fees)
Regulations 1996
The Governor in Council makes the following Regulations:

1. Objective
The objective of these Regulations is to provide
for the payment of fees to the Guardianship and
Administration Board Fund under the
Guardianship and Administration Board Act
1986.
2. Authorising provision
These Regulations are made under section 58A of
the Guardianship and Administration Board
Act 1986.
3. Revocation
The 1 Guardianship and Administration Board
(Fees) Regulations 1992 are revoked.
4. Definitions
In these Regulations—

"estate" means an estate which is subject to an
administration order in the year ending on
the 30 June 1995 or any financial year after
that year;
"the Act" means the Guardianship and
Administration Board Act 1986.
5. Assessment of fortnightly income
The fortnightly income of an estate shall be
assessed by dividing all the income received or
accrued by the estate during the previous financial
year by 26.
6. Annual fees
(1) The annual fee for an estate is—
(a) in the case of an estate with a fortnightly
income of less than $380.00—
nil;
(b) in the case of an estate with a fortnightly
income of $380.00—
$50.00;
(c) in the case of an estate with a fortnightly
income exceeding $380.00—
$50.00 plus an additional $1.00 for
each dollar of fortnightly income in
excess of $380.00.
(2) The maximum annual fee for any estate is
$100.00.
(3) There is no annual fee payable for an estate which
is subject to an administration order under section
60 of the Act.
7. When fees payable
The annual fee for an estate is payable on or
before 31 December following the end of the

financial year in which the fortnightly income of
the estate was assessed.
8. Waiver of fees
The Board may of its own motion or on
application by the administrator waive all or part
of the fee payable under these Regulations if the
Board is of the opinion that the fee would cause
undue hardship to the represented person.
9. Fees for last financial year
Despite regulation 7, the annual fee for an estate
which is subject to an administration order in the
year ending on the 30 June 1995 is payable on or
before 29 February 1996.
