No. 86/1996 Heritage Act 1995 Heritage (Historic Shipwrecks) (Hurricane Protected Zone) Regulations 1996 The Governor in Council makes the following Regulations: Dated: 27 August 1996 Responsible Minister: ROBERT MACLELLAN Minister for Planning and Local Government N. Objectives The objectives of these Regulations are to prescribe certain activities which are prohibited within the Hurricane protected zone, and penalties for undertaking such activities without a permit. 2. Authorising provisions These Regulations are made under section 186 of the Heritage Act 1995. 3. Definitions In these Regulations— "Hurricane protected zone" means the protected zone described in the Schedule and which was declared by publication of a notice in the Government Gazette on 3 August 1995; "the Act" means the Heritage Act 1995. -- 2 of 4 -- S.R. Prohibition of activities likely to damage a historic shipwreck or historic shipwreck relic within the Hurricane protected zone A person must not, except in accordance with a permit granted under section 113 of the Act— (a) moor or use a commercial fishing vessel within the Hurricane protected zone while that vessel is equipped with a harvester, dredge or similar implement which may be deployed for the purpose of taking scallops; or (b) bring into or use a scallop harvester, dredge or similar implement to take scallops within the Hurricane protected zone; or (c) cause a ship carrying any scallop harvester, dredge or similar implement to enter or remain in the Hurricane protected zone. No. 86/1996 Heritage (Historic Shipwrecks) (Hurricane Protected Zone) Regulations 1996 3 SCHEDULE Description of the Hurricane Protected Zone The Hurricane Protected Zone is an area of approximately 28.3 hectares within Port Phillip, approximately 2.7 nautical miles on a bearing of 278.5°(T) from the Eastern Light, McCrae, more particularly described as a circle of 300 metres radius having its centre of reference at latitude 38° 20' 34" South, longitude 144° 52' 12" East, and in which are situated the remains and associated articles of the historic shipwreck Hurricane (1869). ═══════════════ Sch. -- 4 of 4 --
