No. 11/1996 Liquor Control Act 1987 Liquor Control (Infringement Notice) Regulations 1996 The Governor in Council makes the following Regulations: Dated: 20 February 1996 Responsible Minister: VIN HEFFERNAN Minister for Small Business and Youth Affairs KATHY WILSON Clerk of the Executive Council 1. Objective The objective of these Regulations is to provide the prescribed form for an infringement notice. 2. Authorising provision These Regulations are made under sections 145E and 160 of the Liquor Control Act 1987. 3. Commencement These Regulations come into operation on the day on which section 13 of the Liquor Control (Further Amendment) Act 1995 comes into operation. 4. Definition In these Regulations "Act" means the Liquor Control Act 1987. -- 2 of 3 -- S.R. No. 11/1996 Liquor Control (Infringement Notice) Regulations 1996 2 5. Form of an infringement notice For the purposes of section 145E of the Act, an infringement notice is in the prescribed form if it is in writing and contains the following particulars— (a) a reference to the fact that the notice is a notice in relation to an offence under the Act; (b) the date on which the notice is issued; (c) the number of the notice; (d) the name and address of the person alleged to have committed the offence; (e) the date and place of the commission of the alleged offence; (f) a reference to the provision of the Act to which the notice relates and a brief description of the kind of offence alleged to have been committed; (g) the amount of the penalty fixed under section 145G of the Act for the offence; (h) the date and address for payment of the penalty; (i) a statement that if the amount of the penalty is tendered at the place referred to in the notice the matter will not be brought before the Court unless the notice is withdrawn before the end of the period specified in the notice as the time for payment of the penalty; and (j) the name and signature of the member of the police force by whom the notice was issued. ═══════════════ r. 5 -- 3 of 3 --
