Victoria Police Amendment (Merit-
based Transfer) Act 2016†

[Assented to 19 April 2016]
The Parliament of Victoria enacts:
1 Purpose
The main purpose of this Act is to amend the
Victoria Police Act 2013 in relation to the
transfer of certain police officers.
2 Commencement
This Act comes into operation on the day after the
day on which it receives the Royal Assent.

3 Definitions
In section 3(1) of the Victoria Police Act 2013—
(a) insert the following definition—
"Metropolitan position means a position in
Victoria Police that is defined or
described as a Metropolitan position in
an industrial instrument applying to
police officers;";
(b) the definition of country position is
repealed.
4 Transfer on application or request
In section 34(4)(a) of the Victoria Police
Act 2013, for "position" substitute
"Metropolitan position".
5 Promotion and transfer appeals—police officers
In section 141(2) of the Victoria Police
Act 2013—
(a) in paragraph (b), for "position" substitute
"Metropolitan position";
(b) in paragraph (c) omit "or transfer";
(c) after paragraph (c) insert—
"(ca) a transfer to a Metropolitan position of
senior constable (general duties); or".
6 What decisions are reviewable?
In section 146(3)(b) of the Victoria Police
Act 2013, for "country position" substitute
"position that is located outside the Melbourne
metropolitan area and the transfer is".

7 Repeal of amending Act
This Act is repealed on the first anniversary of
the day of its commencement.
Note
The repeal of this Act does not affect the continuing operation of
the amendments made by it (see section 15(1) of the
Interpretation of Legislation Act 1984).
