Victoria -- 2 of 6 -- Health Services Amendment (Health Innovation and Reform Council) Act 2011 No. 17 of 2011 2 Authorised by the Chief Parliamentary Counsel (2) If this Act does not come into operation before 1 March 2012, it comes into operation on that day. 3 Definition Insert the following definition in section 3(1) of the Health Services Act 1988— "Council means the Health Innovation and Reform Council established under Part 6A;". 4 New Part 6A inserted After Part 6 of the Health Services Act 1988 insert— "PART 6A—HEALTH INNOVATION AND REFORM COUNCIL 134P Establishment of Health Innovation and Reform Council The Health Innovation and Reform Council is established. 134Q Functions of the Council The functions of the Council are to provide advice to, and report to, the Minister and the Secretary on the effective and efficient delivery of quality health services at the request of the Minister. s. 3 See: Act No. 49/1988. (2) A member of the Council— (a) holds office for the term, not exceeding 3 years, that is specified in his or her instrument of appointment; and (b) is eligible for re-appointment for a further 2 terms; (c) is entitled to be paid the fees and allowances as are from time to time fixed by the Minister. (3) At least one member of the Council is to be a registered provider within the meaning of the Health Services (Conciliation and Review) Act 1987. (4) The Minister must appoint a member to be the Chairperson of the Council. (5) The Public Administration Act 2004 (other than Part 3 of that Act) applies to a member of the Council in respect of the office of member. 134S Procedure at meetings (1) The Chairperson or, in his or her absence, a member of the Council elected by the members present at a meeting, must preside at a meeting of the Council. (2) The quorum for a meeting of the Council is half of the members for the time being of the Council. (3) Subject to this section, the Council may otherwise regulate its own procedure. s. 4 -- 4 of 6 -- Health Services Amendment (Health Innovation and Reform Council) Act 2011 No. 17 of 2011 4 Authorised by the Chief Parliamentary Counsel 134T Removal and resignation (1) A member of the Council may resign by writing signed by that person and delivered to the Minister. (2) The Minister may remove a member of the Council from office at any time and for any reason. 134U Committee of the Council (1) The Council may, subject to the approval of the Minister, appoint for the purposes of carrying out any of the functions of the Council, a committee consisting of— (a) any members of the Council determined by the Council; and (b) any other persons determined by the Council. (2) A committee appointed under this section must report to the Council. __________________". 5 Repeal of amending Act This Act is repealed on 1 March 2013.
