Purpose The purpose of this Act is— (a) to revoke the permanent reservation over certain land at Belmont; and (b) to revoke the permanent reservation and the related Crown grant over certain land at Moreland South; and (c) to revoke the permanent reservation and the related Crown grant over certain land at Bendigo. Commencement This Act comes into operation on the day after the day on which it receives the Royal Assent. 3. Definition In this Act— "Central Plan Office" means the Central Plan Office of the Department of Sustainability and Environment. 4. Revocation of reservation—South Barwon Recreation Reserve—Belmont The Order in Council specified in item 1 of Schedule 1 is revoked to the extent that it applies to the land shown hatched on the plan in Schedule 2. 5. Revocation of reservation—McDonald Recreation Reserve—Moreland South (1) The Order in Council specified in item 2 of Schedule 1 is revoked to the extent that it applies to the land shown hatched on the plan in Schedule 3. (2) Crown grant Volume 2143 Folio 598 is revoked to the extent that it applies to the land shown hatched on the plan in Schedule 3. 6. Revocation of reservation—Sandhurst Water Supply Reserve—Bendigo (1) The Order in Council specified in item 3 of Schedule 1 is revoked to the extent that it applies to the land delineated and shown hatched on the plan lodged in the Central Plan Office and numbered LEGL./06–046. (2) Crown grant Volume 2614 Folio 760 is revoked to the extent that it applies to the land delineated and shown hatched on the plan lodged in the Central Plan Office and numbered LEGL./06–046. s. 2 -- 3 of 9 -- Act No. 46/2006 Land (Further Miscellaneous) Act 2006 3 7. Consequences of revoking reservations On the revocation of a reservation of land under this Act— (a) that land is deemed to be unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests; and (b) the appointment of any committee of management of that land is revoked to the extent that it relates to that land; and (c) any regulations under section 13 of the Crown Land (Reserves) Act 1978 are revoked to the extent that they apply to that land. 8. Registrar of Titles to make necessary amendments The Registrar of Titles must make any recordings in or amendments to the Register under the Transfer of Land Act 1958 that are necessary because of the operation of this Act. __________________ s. 7 -- 4 of 9 -- Act No. 46/2006 Land (Further Miscellaneous) Act 2006 4 SCHEDULES SCHEDULE 1 LAND IN RESPECT OF WHICH RESERVATIONS ARE REVOKED Item 1—South Barwon Recreation Reserve Situation and area of land: Parish of Corio, County of Grant, being Crown Allotment 2005, being 3244 square metres. Instrument and date of reservation: Order in Council dated 24 February 1926. Description of land by reference to Government Gazette: Government Gazettes dated 27 January 1926, page 186 and 10 March 1926, page 835. Purpose of reservation: Site for Recreation, Convenience and Amusement of the People. Extent of revocation: The land shown hatched on the plan in Schedule 2. Item 2—McDonald Recreation Reserve Situation and area of land: Parish of Jika Jika, County of Bourke, being Crown Allotment 2350, being 1018 square metres. Instrument and date of reservation: Order in Council dated 1 May 1888. Description of land by reference to Government Gazette: Government Gazettes dated 29 March 1888, page 935 and 4 May 1888, page 1302. Crown grant details: Volume 2143 Folio 598. Purpose of reservation: Site for Public Recreation. Extent of revocation: The land shown hatched on the plan in Schedule 3. Sch. 1 -- 5 of 9 -- Act No. 46/2006 Land (Further Miscellaneous) Act 2006 5 Item 3—Sandhurst Water Supply Reserve Situation and area of land: Parish of Lockwood, County of Bendigo, being Crown Allotments 2004 and 2006 and Crown Allotments 20B, 20C and 28B of Section G and Parish of Mandurang, County of Bendigo, being Crown Allotments 2037 and 2038 and Crown allotment 23A of Section G, being in total 193 hectares. Instrument and date of reservation: Order in Council dated 16 January 1883. Description of land by reference to Government Gazette: Government Gazettes dated 8 December 1882, page 2833 and 19 January 1883, page 96. Crown grant details: Volume 2614 Folio 760. Purpose of reservation: Site for Victorian Water Supply purposes.
