Mildura Baptist College 4 ═══════════════ ENDNOTES 5 -- 1 of 6 -- Victorian Legislation and Parliamentary Documents 1 Mildura College Lands (Amendment) Act 2004† [Assented to 7 December 2004] The Parliament of Victoria enacts as follows: 1. Purpose The main purpose of this Act is to amend the Mildura College Lands Act 1916 to make further provision for the distribution of trust funds to schools in the Mildura region. 2. Commencement This Act comes into operation on the day after the day on which it receives the Royal Assent. Interpretation After section 2(fbe) of the Mildura College Lands Act 1916 insert— "(fbf) In this section, a reference to a school listed in Schedule 2, a school listed as a beneficiary in Schedule 2, a school referred to in Schedule 2 or schools listed as beneficiaries in Schedule 2 (however expressed) includes a reference to a school declared to be a school listed as a beneficiary in Schedule 2 by the Minister under section 4;". 4. New sections 4 and 5 inserted After section 3 of the Mildura College Lands Act 1916 insert— "4. Declaration of schools by Minister (1) The Minister, by order published in the Government Gazette, may declare a school to be a school listed as a beneficiary in Schedule 2 for the purposes of this Act. (2) The Minister must not make a declaration under this section unless the Minister is of the opinion that— (a) the school is a State school within the meaning of the Education Act 1958 or a school registered under Part III of that Act; and s. 3 See: Act No. 2842 and amending Act Nos 3522, 5830, 7963, 8860, 8987, 9495, 18/1989 (as amended by Act Nos 48/1991 and 74/2000), 58/1990, 63/1992, 26/1995, 104/1995 and 52/1998. LawToday: www.dms. dpc.vic. gov.au -- 3 of 6 -- Victorian Legislation and Parliamentary Documents Act No. 93/2004 Mildura College Lands (Amendment) Act 2004 3 (b) the school is in that part of the municipal district of the Mildura Rural City Council that is bounded by the Murray River, Meridian Road, Wood Road and Wilga Road and the imaginary extension of Meridian Road in a direct line north to the Murray River, the imaginary extension of Wood Road in a direct line to Wilga Road and the imaginary extension of Wilga Road in a direct line east to the Murray River. (3) The Minister must ensure that an order is published as soon as practicable after it is made in— (a) the Government Gazette; and (b) a newspaper circulating generally throughout the region referred to in sub-section (2)(b). 5. Ministerial orders to be tabled (1) An order under section 4 must be tabled before each house of the Parliament. (2) Section 15 of the Subordinate Legislation Act 1994 applies for the purposes of sub- section (1) as though— (a) an order were a statutory rule (within the meaning of that Act); and (b) notice of the making of the statutory rule had been published in the Government Gazette when notice of the order was published in the Government Gazette.". s. 4 -- 4 of 6 -- Victorian Legislation and Parliamentary Documents Act No. 93/2004 Mildura College Lands (Amendment) Act 2004 4 5.
