Shop Trading Reform (Essential Goods
Amendment) Act 2003 †
[Assented to 15 April 2003]
The Parliament of Victoria enacts as follows:
1. Purpose
The purpose of this Act is to amend the Shop
Trading Reform Act 1996—
(a) to provide for a further category of exempt
shops; and
(b) to allow chemists' shops, petrol shops and
certain other shops selling essential goods to
trade irrespective of the number of persons
employed in the shops.

2. Commencement
This Act comes into operation on the day on
which it receives the Royal Assent.
3. Amendment of section 4
(1) After section 4(1) of the Shop Trading Reform
Act 1996 insert—
"(1A) A shop is also an exempt shop if the
predominant business carried on in the shop
is of a prescribed kind.
(1B) The Minister may only recommend the
making of Regulations prescribing a kind of
business for the purposes of sub-section (1A)
if the business is one of selling goods that, in
the opinion of the Minister, are essential
goods.".
(2) After section 4(3) of the Shop Trading Reform
Act 1996 insert—
"(4) Sub-section (2) does not apply to—
(a) a chemist shop; or
(b) a petrol shop; or
(c) a shop in which a business of a kind
prescribed for the purposes of sub-
section (1A) is carried on.".
