[Assented to 14 October 2003]
The Parliament of Victoria enacts as follows:
1. Purpose
The purpose of this Act is to amend section 21 of
the Supreme Court Act 1986 to clarify the power
of the Supreme Court to declare a person to be a
vexatious litigant.
2. Commencement
This Act comes into operation on the day after the
day on which it receives the Royal Assent.

3. Amendment of section 21
(1) In section 21(2) and (3) of the Supreme Court
Act 1986, after "legal proceedings" (wherever
occurring) insert "(whether civil or criminal)".
(2) After section 21(7) of the Supreme Court Act
1986 insert—
"(8) The Court may, in determining whether to
make an order under sub-section (2), take
into account vexatious legal proceedings
(whether civil or criminal) instituted before
or after the commencement of the Supreme
Court (Vexatious Litigants) Act 2003.".
