Purpose The main purpose of this Act is to provide for the revocation of reservations over several parcels of land and the revocation of a Crown grant affecting one of those parcels. Commencement (1) This Act, except section 5, item 3 of Schedule 1 and Schedule 3, comes into operation on the day after the day on which it receives the Royal Assent. (2) Subject to sub-section (3), section 5, item 3 of Schedule 1 and Schedule 3 come into operation on a day to be proclaimed. (3) If a provision (including an item in a Schedule) referred to in sub-section (2) does not come into operation on or before 1 July 2001, it comes into operation on that day. 3. Revocation of reservation—Barwon Heads land The Order in Council specified in item 1 of Schedule 1 is revoked to the extent that it applies to the land shown hatched in the plan in Schedule 2. 4. Revocation of reservation and Crown grant—Ballarat land (Old Colonists Association land) (1) The Order in Council specified in item 2 of Schedule 1 is revoked. (2) Crown grant Volume 5623 Folio 544 is revoked. 5. Revocation of reservation—South Melbourne land (Charles Grimes Bridge) The Order in Council specified in item 3 of Schedule 1 is revoked to the extent that it applies to the land shown hatched in the plan in Schedule 3. 6. Consequences of revoking reservations On the revocation of an Order in Council reserving land— (a) that land is deemed to be unalienated land of the Crown, freed and discharged from all s. 2 -- 3 of 9 -- Act No. 3/2001 Land (Further Revocation of Reservations) Act 2001 3 trusts, limitations, reservations, restrictions, encumbrances, estates and interests; and (b) the appointment of any committee of management of that land is revoked to the extent that it relates to that land; and (c) any regulations under section 13 of the Crown Land (Reserves) Act 1978 are revoked to the extent that they apply to that land. 7. Registrar of Titles to make necessary amendments The Registrar of Titles must make any recordings in or amendments to the Register under the Transfer of Land Act 1958 that are necessary because of the operation of any provision of this Act. __________________ s. 7 -- 4 of 9 -- Act No. 3/2001 Land (Further Revocation of Reservations) Act 2001 4 SCHEDULE 1 LAND IN RESPECT OF WHICH RESERVATIONS ARE REVOKED Item 1—Barwon Heads land Situation of land: Township of Barwon Heads, Parish of Conewarre, County of Grant. Instrument and date of reservation: Order in Council dated 25 October 1880. Description of land by reference to Government Gazette: Government Gazettes dated 21 January 1876, page 96 and 29 October 1880, page 2261. Purpose of reservation: Site for Public Purposes. Extent of revocation: The land shown hatched on the plan in Schedule 2. Item 2—Ballarat land (Old Colonists Association land) Situation and area of land: Parish of Dowling Forest, being 4·047 hectares, being Allotment 1, Section 3. Instrument and date of reservation: Order in Council dated 5 June 1929. Description of land by reference to Government Gazette: Government Gazettes dated 8 May 1929, page 1429 and 12 June 1929, page 1727. Purpose of reservation: Site for an Asylum for Indigent Members of the Old Colonists Association of Ballaarat. Particulars of Crown grant Crown grant Volume 5623 Folio 544. Extent of revocation: The entire reserve. Instrument and date of reservation: Order in Council dated 2 July 1996. Description of land by reference to Government Gazette: Government Gazette dated 4 July 1996, page 1712. Purpose of reservation: Site for Public Purposes (Wharf and Associated Tourist Facilities). Extent of revocation: The land shown hatched on the plan in Schedule 3.
