Statute law revision 3 ═══════════════ NOTES 4 -- 1 of 5 -- 1 Agricultural and Veterinary Chemicals (Control of Use) (Amendment) Act 2000 † [Assented to 6 June 2000] The Parliament of Victoria enacts as follows: 1. Purpose The purpose of this Act is to amend the Agricultural and Veterinary Chemicals (Control of Use) Act 1992 to provide for the labelling of meal derived from material of animal origin. Commencement (1) Subject to sub-section (2), the provisions of this Act come into operation on a day or days to be proclaimed. (2) If a provision referred to in sub-section (1) does not come into operation before 30 May 2001, it comes into operation on that day. 3. Definitions In section 4(1) of the Agricultural and Veterinary Chemicals (Control of Use) Act 1992— (a) in the definitions of "advice note", "label" and "package", for "or stock food" (wherever occurring) substitute ", stock food or meal of animal origin"; (b) after the definition of "maximum residue limit" insert— ' "meal of animal origin" includes a mixture of meals of animal origin;'. 4. New section 20 inserted After section 19 of the Agricultural and Veterinary Chemicals (Control of Use) Act 1992 insert— "20. Labelling of certain meal of animal origin (1) A person who manufactures meal of animal origin must not sell the meal to another person unless the meal is accompanied by a label or advice note that complies with the regulations. Penalty: In the case of a corporation, 400 penalty units. In any other case, 200 penalty units. s. 2 No. 46/1992. Reprint No. 2 as at 8 May 1997. Further amended by Nos 58/1997, 46/1998 and 52/1998. -- 3 of 5 -- Act No. 33/2000 Agricultural and Veterinary Chemicals (Control of Use) (Amendment) Act 2000 3 (2) If a change is made to the requirements for a label or advice note, the chief administrator may direct, by notice to a person who manufactures meal of animal origin, that the meal must not be sold after the date specified in the notice without a label or advice note that accords with the new requirements. (3) A person who receives a notice under sub- section (2) must comply with it. Penalty: In the case of a corporation, 100 penalty units. In any other case, 50 penalty units. (4) Nothing in this section applies to a prescribed meal of animal origin.". 5. Regulations In section 27(i) of the Agricultural and Veterinary Chemicals (Control of Use) Act 1992, in sub-paragraphs (iii) and (iv), for "or stock foods" substitute ", stock foods or meal of animal origin". 6.
