Purpose The main purpose of this Act is to provide for the revocation of reservations and a Crown grant affecting various parcels of land. 2. Commencement This Act comes into operation on the day after the day on which it receives the Royal Assent. Revocation of reservation—Boort racecourse land The Order in Council specified in item 1 of Schedule 1 is revoked. 4. Revocation of reservations—Stawell hospital site land (1) The Orders in Council specified in items 2 and 3 of Schedule 1 are revoked. (2) Any reservation of the land shown hatched on the plan in Schedule 2 (whether by Act, Order in Council or other instrument) is revoked. 5. Revocation of reservation—Lorne land The Order in Council specified in item 4 of Schedule 1 is revoked. 6. Revocation of reservation—Albert Park land The Order in Council specified in item 5 of Schedule 1 is revoked to the extent that it applies to the land shown hatched in the plan in Schedule 3. 7. Consequences of revoking reservations On the revocation of an Order in Council reserving land or the revocation of any reservation of land under section 4(2)— (a) that land is deemed to be unalienated land of the Crown, freed and discharged from all trusts, limitations, reservations, restrictions, encumbrances, estates and interests; and (b) the appointment of any committee of management of that land is revoked to the extent that it relates to that land; and (c) any regulations under section 13 of the Crown Land (Reserves) Act 1978 are revoked to the extent that they apply to that land. s. 3 -- 3 of 9 -- Act No. 40/2000 Land (Revocation of Reservations) Act 2000 3 8. Revocation of Crown grant—Clunes Borough Chambers land (1) Crown grant Volume 169 Folio 725 is revoked. (2) On the revocation of Crown grant Volume 169 Folio 725, the land contained in that Crown grant reverts to the Crown and becomes unalienated Crown land but that revocation does not affect the continuity or status of the reservation of that land by Order in Council dated 8 May 1865 and published in the Government Gazette dated 16 June 1865 at page 1339. 9. Amendment of definition in Australian Grands Prix Act 1994 In section 3(1) of the Australian Grands Prix Act 1994, in the definition of "Albert Park", after "1997" insert "or the land shown hatched on the plan in Schedule 3 of the Land (Revocation of Reservations) Act 2000". 10. Registrar of Titles to make necessary amendments The Registrar of Titles must make any recordings in or amendments to the Register under the Transfer of Land Act 1958 that are necessary because of the operation of any provision of this Act. __________________ s. 8 No. 68/1994. Instrument and date of reservation: Order in Council dated 13 October 1931. Description of land by reference to Government Gazette: Government Gazettes dated 16 September 1931, page 2603 and 21 October 1931, page 3025. Purpose of reservation: Site for a Racecourse and other purposes of Public Recreation. Extent of revocation: The entire reserve. Item 2—Stawell hospital site land Situation and area of land: Township of Stawell, Parish of Stawell, County of Borung, being 3·852 hectares, being Allotments 7 and 9, Section 270. Instrument and date of reservation: Order in Council dated 20 November 1883. Description of land by reference to Government Gazette: Government Gazettes dated 19 October 1883, page 2414 and 22 November 1883, page 2634. Purpose of reservation: Site for Hospital. Extent of revocation: The entire reserve. Item 3—Stawell hospital site extension land Situation and area of land: Township of Stawell, Parish of Stawell, County of Borung, being 2·023 hectares, being part of Allotment 8, Section 270. Instrument and date of reservation: Order in Council dated 19 August 1861. Description of land by Government Gazette dated 6 September Sch. 1 -- 5 of 9 -- Act No. 40/2000 Land (Revocation of Reservations) Act 2000 5 reference to Government Gazette: 1861, page 1700. Purpose of reservation: Site for an Extension of Hospital Site at Stawell. Extent of revocation: The entire reserve. Item 4—Lorne land Situation and area of land: Township of Lorne, Parish of Lorne, County of Polwarth, being 1315 square metres less excision authorised by Act No. 90/1994, being Allotment 2F. Instrument and date of reservation: Order in Council dated 19 December 1898. Description of land by reference to Government Gazette: Government Gazettes 4 November 1898, page 3914 and 23 December 1898, page 4614. Purpose of reservation: Site for a Public Hall and Free Library. Extent of revocation: The entire reserve. Item 5—Albert Park land Situation and area of land: City of South Melbourne and at St. Kilda, Parish of Melbourne South, County of Bourke, being 230·7 hectares less authorised excisions. Instrument and date of reservation: Order in Council dated 21 March 1876. Description of land by reference to Government Gazette: Government Gazettes 21 January 1876, page 96 and 24 March 1876, page 568. Purpose of reservation: Site for a Public Park.
